Selling my house without an estate agent

Hi

I am hoping for some advice with regards to seling my house.

I know someone who wants to buy my house its not on the market yet. With out an estate agent just a soliciter.

I am wanting to know how I go abou this?

I had it valued and they are going to just check they can get a morgage for that amount.

I have someone coming to do a energy test £99 soon from the estate agent. Its not on the market yet as they need to do photos etc, they have only phoned round the people on their books to see if they would like to view it.

Its with a agent with no sale no fees I have looked on the internet and have seen a few people selling there houses with different estate agents.
I have also looked into the small print of the NO SALE NO FEE.
I just dont want to pat the £99 energy test if I dont need it or would my soliciter ask for it anyway?.

Is there any web sites to help me or past posts on here?

    Make sure you don't have to pay to get out of that contract with the EA if you do use them!

    Have you signed anything with any EA yet?

    I'm pretty sure you need the report anyway, but someone else will confirm, I expect.

    Make sure you give the estate agent the full name and address details of your potential buyer BEFORE you sign any contract with the agent, making it clear the agent will receive no payment should you sell to this buyer.

    If you leave it too late, the agent can and will claim payment for the introduction.

    This is a personal experience, but you absolutely can sell your house without an EA. I did. I went with HouseNetwork who I believe are still going, but there are others out there. All you need is a conveyancing solicitor. It is possible to do the conveyancing yourself I'm told, but personally, I wouldnt dare. It's such a legal minefield that one slip could cost you thousands, it just wasnt worth the hassle to save a few hundred pounds.

    With regard to getting rid of your current agent, be prepared for a bit of a fight. As others have said, tell the agent the name and address of your potential buyer and make it clear IN WRITING that they will not be paid for this and they cannot consider it an introduction in any way. EA's engage in all sorts of shady practices. When I was selling mine, my husband called me up because he had seen our house on an EA's website which was a suprise since I wasnt using an EA, it turns out, the cheeky so-and-so's had stolen the images from rightmove and began marketing my house without even asking me. They were quite put out when I told them to remove it from their site.

    Thing is I have seen a few people advertise there house with a few estate agents so what differnce does it make.

    I signed to go a head as the small print stated there will be no fees if I with draw only DISBERSEMENTS
    I asked about this and she said solicter fees.


    I am rather conerned now as I emailed them and they phoned me back to explain the samll print.

    Does anyone now if I do need a energy test to sell my house?

    Disbursements are things that the solicitor pays out in connection with a conveyance.

    If you are confident that you haven't given a verbal agreement or signed a contract with an EA then you should be OK to sell your house to the person you have in mind, without incurring EA fees, assuming that the EA didn't introduce the person to you.

    I bought my house from a friend without EA involvement. We sat down and agreed the price, then instructed our individual solicitors and things proceeded normally thereafter. She should have had an EPC report before the sale but my solicitor wrongly advised that it wasn't advised - and as it was a purchase from a friend I didn't push the issue.

    As I understand it, the EPC is a legal requirement to market your house. If you don't advertise it, I don't believe it is required for the sale to take place but I am not 100% on that.

    If you haven't signed the contract with the EA yet, you can just tell them that you've changed your mind and you don't want them to act for you. DON'T let them come over to take the pictures and measure up for the details. Instruct your solicitor and get on and sell to this friend and don't worry about the EA.

    If you have signed the paperwork, you'll need to read the contract conditions carefully. You need to understand a) what it says about terminating the agreement and b) what it says about when fees are due. Provided that fees are only due if they introduce the buyer, you need to make them aware of this buyer NOW before they do any marketing. If they hear that you've sold while you are in a contract with them, they will try claiming their fees on the basis that the buyer found out it was for sale through their advertising (i.e. their introduction). Tell them about it in writing now before they've advertised anywhere and it stops their claim before it starts.

    If the EA can find an avenue to claim fees from you, they will - even if they didn't do the work to get the sale. You need to make sure that they can't claim so that you don't have to fight them later. It might be "No Sale No Fee" but that only applies if you don't sell. If you sell to your friend, there is a sale and it ends up being a debate over whether they have any right to a fee from you.

  • you can get an EPC yourself, loads of companies online, I paid £37 & he came on the same day. Certificate was emailed to me within 2 hrs.
