Hammersmith PCN

I received a parking ticket from Hammersmith and Fulham Council.

I had been parked in a Pay and Display car park for Queen Charlotte Hospital, where my wife was undergoing surgery. I had a ticket which expired at 14.36, and I went out and got a fresh ticket at 15.01 with expiry time of 16.01.

The ticket I received was issued at 15.23; both pay and display tickets had been on my windscreen.

I submitted an appeal to the council through their online appeal link and sent a scanned copy of the ticket with expiry time 16.01; this appeal has now been refused: the reply says:
“I have carefully considered what you say and all the available evidence, but I do not agree that we should cancel your liability for this PCN.
The PCN was issued because the vehicle was parked in a pay and display car park, after the expiry of the pay and display ticket seen in the vehicle.
The Civil Enforcement Officers notes state that the pay and display ticket in your vehicle (number 1012865) had expired at 14:36. The Penalty Charge Notice was issued 47 minutes after expiry of the ticket at 15:23. The information label on the front of all our pay and display machines states quite clearly that;"it is an offence to remain parked after expiry of paid period".
The amount of parking time given by the money inserted in to a pay and display
machine is indicated on the machines digital display. The expiry time is also clearly printed on the ticket.”

I would be grateful for any advice or help with two questions:

1.Can I still submit a formal appeal to the Council, or is the online appeal the formal appeal?
2.What are my prospects of challenging the Council’s decision, or should I pay the £40 now?

    The online is an informal appeal. A formal appeal is made to the Notice to Owner (at which point you will have lost the discount)

    Assuming you still have the 2nd P&D ticket, I would say your prospects are good, but it's likely you will need to go to adjudication

    Most people win who appeal as far as an adjudicator, it's not daunting and the odds are in your favour. If there was no prohibition of buying another ticket to extend your time then your tickets covered you for the time the PCN was issued.

    They are the experts and can help you through the appeal process. You will need to include pics in your post so read some other threads first to see what you need to show, as a new poster. Then the regulars can advise you about any other points of appeal such as errors in the PCN wording, etc., (never overlook a possible appeal point because adjudicators sometimes find in your favour on the apparently 'weakest' argument).
