advice and help needed please

My partner recently "asked" one of these large companies to help him in claiming his Mis sold "ppi's back - however today we have had a letter stating

"we have carried our a review of your file and regret to inform you that B##### #######" is unabe to act for you in this matter. This does not mean that you do not have a valaid complaint and we wish blah blha blah".

so i am going to take this up myself and attempt to claim the PPI back for my oh - only thing is i dont know where to start !

we want to claim back from two companies, these being
Ocean finance - a loan that was paid back in full in 2004
Souther pacific mortgage a mortgage that was paid back in full 2006. He knows he was mis sold these as he had bad credit rating and was told if he did not have the PPI he would not get the mortgage or loan !

Any advice would be greatly appreciated - oh and we no longer have the account details, I.E. account numbers :(

are we going to be able to claim anything back ?

    The only way to find out is to make a complaint and see what happens.

    Contact the lenders and ask them for the account numbers, give them his full name, date of birth and address at the time of the loans.

    Then make a misselling complaint, giving as much information about the sale as possible and the reasons why you believe it was missold.

    They are obliged to investigate - and the whole process will cost you nothing. Using the claims company would have cost a substantial amount of any payout.

    Thank you, i will draft the request letter today and have him sign it and then pop it in the post.

    Fingers crossed, we will get a positive outcome.

    If Belmont Thornton (i assume you meant them!) cant be bothered they probably know theres little chance.
    The date taken out is more relevent to when they were paid off if you talking about sales, when were they sold?

    no it is not those one you have named. cannot recall the exact date that they were sold, but about8/9 years ago now.

    I spoke to Ocean Finance and they have confirmed that PPI was paid and they are going to "look into it" and send us a letter to confirm that we are applying to have this refunded - all seems to easy to be true with this one !

    With regards to the other, they have changed their names soo many times, but finally tracked them down - but they are not being very helpful and need letters and such, so will get that over to them tomorrow.

    good luck, im so suprised a cmc turned down business. im so used to seeing complaint letters about PPI on accounts where PPI doesnt even exist!

    Just a quick thank you - so far my partner has had money refunded for unfair bank charges. and i have just claimed back £208. from C&G for a MEF back in 2006.
    still waiting for the Ocena and SFM to get themselves sorted, they are asking for proof of new address ETC. but will get there in the end.

    Advice needed - dont know what or who to contact now ....
    Just had a letter back form Ocean Finance and they have stated that in in 2005 OFML acquired "OCEAN fINANCE" FROM Mr Newey (Paul) including certain customer records and the right to use certain "ocean finace" trademarks. the "SPA" deals with the private arragements as between Mr N and OFML, however, and does not confer any rights upon and third parties such as lenders or borroweres intoduced to each other by OF, Indeed any third party rights are expressly excluded.
    for OFML to have acquired any direct liabilty or responsibility to any customer in connection with an arrangement made pror to 14 jan 2005, there would have to have been;
    1 a specifice agreement as betweent Mr N, trading as OF and that customer

    2 Mr N and the customer would have to had to expressly agree that any obligations owed by him under that agreement would be transferred to OFML with effect 14 jan 2005 known as "novation"

    OFML has no record of any novation involving you. in the absence of novation there is no basis for any claim against OFML.(not suprised at that one really)

    They have given me the PO Box for Mr N, and they state that they have sent a copy of the same letter to Mr N

    Any suggestions / points in the right direction would be greatly appreciated
