Hi everyone.
Just a quick query, my daughter had a fall yesterday in Queen St Cardiff, there was a residue of wet cement on the floor & no signs...
She has now a pair of cement covered jeans, a covered bag, a pair of cementy converse trainers & most importantly a broken camera which was given to her from her grampy who we lost last year.
As you can imagine, this is a sentimental item and she is quite upset about this....
Where would i start with this, any help gratefully received.
Where do you start with what?0 -
If she fell because of a council related issue; ie pot hole, hole in the floor etc then she starts by contacting the council. If she fell over because she's a bit clumsy then its her own fault.0
-
Start with either finding out who left the cement on there and seeing what their public liability insurance says, or having a word with your daughter and reminding her that looking where she's going is normally a good policy.0

Compensation of course - the Converse trainers will be one offs and irreplacable (but without a receipt of course) and she'll have a major bruise on her bottom which will cause untold stress.
On a serious note to the OP I'd start by going to a clothes shop and buying some new clothes, a camera shop to see if it can be repaired and then I'd be doing a short refresher course on 'walking for beginners' followed by 'avoiding obstacles'0 -
And a crash course in taking responsibility for yourself.0

and don't let the council know as she's effectively stolen their cement.0

Well the cement can wash off. How did the camera get broken, was she using at the time when she fell? You haven't really said how she fell, ie, was it a result of the groundworks or did she simply trip and fall into the cemented area.0

Was your daughter the only one to fall over in that spot?
You've left yourself so wide open to ridicule, I can't even bring myself to tease you.
Wash the clothes straight away, get a new camera and look where your going would be my advice. You have been reading.....another magnificent post by garethgas :beer:0 -
I think you guys have been on the board a little to long as your comments are a tad unfair.
Yes she may want some costs back, i asusme you have all taken a disliking because you see it as another case of "what can I get", but in fairness, why not because everyone else does.Start with either finding out who left the cement on there and seeing what their public liability insurance says, or having a word with your daughter and reminding her that looking where she's going is normally a good policy. On a serious note to the OP I'd start by going to a clothes shop and buying some new clothes, a camera shop to see if it can be repaired and then I'd be doing a short refresher course on 'walking for beginners' followed by 'avoiding obstacles'

I personally would not be able to tell the difffernce between wet and dry concret if simply walking down the road (unless i had been using it and seen the before/after colour, like with paint). This is mainly due to never seeing wet concret that had obviously just been laid.
Nor do i expect to come across some when trotting to the shops. Not every accident is a claim, despite what the shyster TV ads may imply
I shall assume that you mean the OP shouldn't be looking for any costs back (for her daughter that is) due to the incident.
From my very basic point of view, i cannot see how this 'wet concrete' was so glaringly obvious that it's the OP's daughters fault for walking through it (unless it was around active works, but as the OP states no signs)
Your all happy to snap but what happens if the OP's daughter is 10? or has mobility issues? Will the funny comments still be funny or just rather insensative.
I think you should give the OP a better chance TBH
OP: How old is you daughter? Did this happen near 'active works'? How did the camera get broken?
I personally think if there was negligence then your daughter should get some money back depending on the circumstance. But thats my opinion and after this rant i'm ready to get a good backlashI get what i want. That isn't because i'm a brat or spoilt. It's because i'm determined, i work hard for it and i achieve my goals!0
