DS taken from basket for price increase during purchase - Game

Buying a wine red DS XL at £119.98 this afternoon and before my eyes the item was removed from my basket during the purchase and the price was upped to £139.99. The screen still showed £119.98 and when I phoned customer services they were happy to sell it to me at that price. When she tried to buy it she too could only do it for £139.99. Many phonecalls later they say it was their error and will not honour the price. I do have a copy of the page detailing the lower price but their system will not accept a .xps file. Where do I stand?????:mad:

Was it priced in store at £119.98 or have you just taken the online price and expected them to honour it in-store ?0 -
No it was an online purchase and then followed on with a phonecall to the online customer service team for Game. They offered a £10 discount but refuse to sell it at the price that they had originally advertised it at.0

You have no legal rights. They didn't accept the order, no money changed hands and they didn't didn't dispatch it.0

As above you have no legal right to it at that price, them offer you a £10 voucher is being generous, they don't have to. Even if you had got as far as paying for it the order is still not accepted until delivery is confirmed. Errors happen on websites, if it had been up for 1p would you have still expected to be able to purchase it!!Everyones opinion is the most important.....no wonder nothing is ever agreed on.0

It generally depends on when their T&C's state a contract is formed and becomes legally binding. If they state its when payments taken then that would be when. Although in my experience 99% of companies always say its when the goods are sent.
But i've yet to see any company state a contract is legally binding the moment you put items into your basket/look at them online. And i think they would have a impossible job trying to enforce any contracts that were made under such terms.

Most online retailers will take payment straight away from a debit/credit card but it doesn't mean the order has been accepted like you said its usually accepted when the items are cleared for dispatch.Everyones opinion is the most important.....no wonder nothing is ever agreed on.0
