house in ex's name.... tax credit as single person

Hi Everyone.

I am in a bit of a situation and would just like any advice people have....

Almost a year ago my boyfriend of 3 years and I decided to set up home together. I gave up my council house, he moved out of his parents and we bout a house 40 miles away as I wanted to move away from where we were. He kept his job and did the daily comute and i got myself a job here working school hours around my daughter.

Now, when we decided to buy a property, we did it all in his name as the mortgage advisor told us it would go against the amount we could borrow as i did not have my p/t job then, so he would have myself and my daughter as dependants on his income. So we did as advised and the mortgage and property all went in his name.

We are now breaking up. Everything has gone wrong between us. Maybe the pressure of moving away, maybe a mortgage.....who knows. But it has left me in a mess. He is prepared to move back to his parents, back closer to his work, and he says me and little un can stay here indefinately (until we dicide what to do). But it means i now need to make a single claim for tax credits/council tax. Can i do that when the property is in his name?

I will only be able to afford part of the mortgage, and tbh i don't want to pay the whole mortgage for a house that he owns. I will not see anything back.

If he agrees to pay a third of the mortgage-do i have to put this as my income aswell? All other bills etc will be in my name. I am scared to death that i can't claim on my own even tho i will be, all because of a stupid piece of paper.

I don't really want to find a new house, near school and work to rent privately if i dont have to just yet. Although i do know that housing benefit would make up some of my rent that way, and staying here i cant get help towards the house cost (hence why i am hoping he will agree to pay a third of it).

Sorry to ramble, just trying to work out what i can do for the best.

    You can still claim tax credits as a single person, who owns the house you live in has nothing to do with it.
    You wont get any help with the mortgage as you are working and its not your house.
    Would it not be better to look for another house for you and your daughter and claim the housing benefit?

    Thanks for your reply.

    We will be looking for another property, but i have to be specific where i look due to schooling and work. I also dont want to put my daughter through any more upheaval if i can avoid it. I took her away from her school and friends and it is taking a long time for her to settle here, and on top of that i lost my mum recently and could do without feeling that i have to find somewhere and move in a huge hurry. This whole year has been awful and this break up is not helping. I want to keep things as normal as i can for my daughter for as long as i can really.

    I have veiwed a couple of properties, but not found anything yet.

    Will keep a hunting tho.
