unlawful bank charge from barclays bank

on friday the 15th of july i was in credit of £124, i then got a payment for a further £220 on friday the same day, i withdrew £190 from my bank account and yet they say to me than i am £95.99- overdrawn what the hell?! on top that they will be charging me £22 to cover the overdraft, what a complete con.

i went into my local bank today to discuss this matter and they said that it was my fault for going overdrawn, how can it be my fault when i clearly had enough money in the 1st place!

according to my statements on the 11th of july i had £132.59 within the 11th of july i had spent £38.58 which according to them leaves me £94.01 on the 12th july.

they then say to me (according to my statements) that i didn't have enough to withdraw the £190 and that then left me with the £95.99- overdrawn, but how can i be overdrawn if i received a payment of £220 on the same day? (yet their statements are saying that i received the payment of £220 on the 18th of july which is incorrect) i went shopping on friday not today!

their online statements and their bank statements that you print off are completely in the wrong order, they put transactions on the wrong days and at the wrong times and they charge me because of that error, is that fair on me? no it is not fair, i am sure i am not alone and that other people are experiencing the same problem.

i will be requesting legal aid from the citizens advice bureau, today it was shut so i didn't have a chance to go in there, i just hope they can help me in this case, i have picture proof of the error (today it shows that i am £5.06 in credit which is the correct amount) and i know exactly how much i spent and what day too, how can this be fair to us when they treat us like this?

    Have you read the T&Cs of your account? Do you know about clearing cycles? Do you know about when you must have money in your account to cover outgoings?
    Check these first before you talk about unlawful and legal aid.
  • What was the payment in - was it a cheque - they take a number of days to clear - the experts on here can tell you how many after they are paid in and appear on your account.
    I'm equally not sure myself how long payment in by bank transfer (bacs) or faster payments (FP) take to clear.
    Note - just because a payment in appears on your account does not mean it has cleared and is available to withdraw - that how it has always been since banks were invented.
    I think cash paid in IS available to withdraw immediately.

    So although you think you had £132.59+£220 in your account and available to withdraw, actually you only had the £132.59 - until the payment in has cleared.

    You need to check the terms & conditions of your account. They will tell you explicitly when credits to your account are available for withdrawal.

    What makes you think that the incoming payment of £220 arrived as cleared funds in your account on Friday 15th?

    Exactly which law are you accusing them of breaking? I wouldn't go in to the branch accusing them of that, you may end up without an account.

    I do find it very amusing when new posters post things such as unlawful, rip-off, con, requesting legal aid, having proof of errors blah blah ..when they clearly know very little about how simple banking procedures work. Best to polish up on your knowledge before also amusing those busy helpful people at the CAB. They have better things to do than amuse you and your whims.
    Try listening to what your bank are telling you and then try to understand it !

    If the funds are not deposited by 330pm on Friday the funds will not appear on your account until the next working day (Monday), perhaps this is the issue?
  • If a cheque was paid in on the Friday before 3:30pm (or whatever your bank's cut off time is then it would be available to draw against on the following Wednesday. If it was after 3:30pm/cut off then it wouldn't be available to draw against until the Thursday.

    This would mean that unless you received other monies into the account on the Friday, you only had £124 to spend yet you withdrew £190 - hence you were overdrawn.

    You really should take the advice mentioned on here and listen to what your bank is telling you before accusing them of breaking the law etc.
    Before you ask, yes, I work for a bank, but no, I didn't get a bonus!
