Next Directory PPI

Just after a bit of advice regarding a claim that I put in to the Next Directory as I think that I was mis-sold PPI.

Bit of background - I took out a store card when I was 17 (I was a full time student at the time, but was working evenings and weekends). I don't remember actually requesting to take out any PPI. In fact, I suppose down to being naive, I didn't really query it when I saw it on my monthly statements (it was the first account that I had ever had 'on credit').

The PPI was set up on 2nd October 1998. The account itself has not been used for some time but is still open.

Anyway, I sent off the for the credit agreement and on receiving it, I completed the PPI claim questionnaire and sent it off. I received a letter from Next a few days ago and they have said;

"at the time the account was opened, you would have had to specifically request that the policy be taken out, either by ticking the appropriate box on a Directory card request form, returning a Payment Protection coupon or by verbally requesting an application form by telephone. The Terms and Conditions were then sent to you".

I am aware that the Next Directory were not regulated by the FSA prior to January 2005 but was still planning on submitted my case.

Has anyone else had any experience of the Next Directory and is this just their standard line to fob people off?

Any help would be greatly appreciated, thanks.

    I've not had any experience of Next, but the last time someone responded to me with a 'would have' and 'either by' kind of letter I sent it back and asked them to clarify "which?" since none of them applied to me.

    They were trying to disguise the fact that they had no records of the sale, and no copies of any documents signed by me. They agreed to settle "without admission of liability".
  • Thanks for this DrSqueeze. To be honest, I cannot remember that far back but find it highly unlikely that I would have requested such an insurance as it I wouldn't have known what it was!

    It is worth a shot, so I think that I will send them a similar responce.

    Yes they are trying to 'fob' you off, persist - if they are not willing to resolve the dispute to your satisfaction, you can pursue the matter in your local County Court. However it will cost you to register the claim - depends on the value that you are trying to claim back. you need to ask them basic information, i.e original request for ppi, copy of credit agreement which you signed, there insurers details. Don't give up!!! Clearly if they can't produce any evidence that you requested for ppi, then consider County Court Action. Make it clear to them that you mean business!! They will do everything not to solve your dispute, including allocating different case workers on your complaint & receiving different response everytime you ask them questions/information. They will try to send you on a bender, just to avoid paying out, if that happens i would consider County Court Action Against them & sent you correspondence via recorded delivery .
