Assuming you have the log book you can tax it online.
No he can't as he has moved from the address on the logbook.
OP - tax it now asap at post office using logbook, mot and insurance. Then your best bet is to ring DVLA and see if a fine has been issued to you. If it has been issued it will probably be £80 (unless it has gone to court) plus the back tax. If you chose to ignore it and do nothing then a CCJ could be issued if it goes to court. If you are lucky and no fine has been issued then you will be asked to send payment for the missing tax to your local DVLA office. You also need to change your address on your logbook.
