Hi everyone - hope someone can help. I worked for a company for 4 years and was just made redundant. I am getting redundancy pay and had to practically beg them to tell me how much and if I was due any holiday pay.
It's the holiday pay I need help with. The company I worked for bought over another company. Our company decided to change our holiday entitlement which was January to December to the other company's holiday entitlement which would run from beg May to end April next year - with me so far??
We all got letters saying our holidays had been pro-rated so instead of my annual hols ( excluding bank hols) which were 23 days I would get 32. It seems however for purposes of redundancy they are sticking to old system we were on
Is that right and fair?

A couple of questions.
When did the new company take over and change the holiday year?
Have you taken any leave under the old system and the new system?
Without knowing the when it is hard to work out what you should get. However 23 days is below the minimum unless Bank Holidays were added on top - this is where it can get muddled and confusing. The new company may well be giving an inclusive BH AL allowance.Truth always poses doubts & questions. We bought over this other company - no-one knows why it was decided to change our holidays to go with their holiday year. I had some under the old year a couple under the newly changed holiday year. I got 23 days but on top of that I had about 8 public hols or 7 - can't remember!!0 -
You don't get all the holidays you get prorata
Need details of holidays taken from Jan10 through to date of redundancy including back holidays
the day they made the changeover.
Old holidays were 23 + 8
Whats the new holidays if 32 then thats the same which is ok are there BH on top?
on the date of changeover how many holidays did they tell you you had left.

It would have been 23 up until December 2011 on our old system. Since we will now have to wait until end April 2012 before we can start new year it was pro rated up to 32 days - this did not include bank holidays.
They said I had 6 days left. I think I used up 8 probaly 6 (approx) under old regime and 2 under new regime.
I was made redundant on 11th July.0 -
When did they make the change?
Bank holidays make it a bit more complicated so put them to one side.
If it was dec/jan then thye need to add 1/3 to the total JAn to April 12
31 so 32 seems fair. ternination 11july sos lets say 6.5 months since jan.
special holiday year is 16months accrued holiday is around 13.
Did you use all your 20110 holiday or carry any over?
Asuming no carry over none you have 13 days less those you took in jan-11 july.
if that was 8 then I make it 5 left.

Well it is difficult to tell because you have not provided the information asked for.
Based on my assumptions I think they have been generous with the holidays.0
