    I am sorry I neither wished to alienate nor exclude anyone from this forum.

    I am not a regular but I was under the impression that anyone could ask for help on this website and it is only because I am desperate that I am doing so.

    I was hoping for some support and if I have upset you I apologise it was not my intentions but because I am not a regular and don't know all "the rules" then I erroneously omitted to say I am Scottish and that is what has caused you to "spit your dummy out" as we say in Scotland.

    Sounds like you should have been more clued up on what could/should/would happen in various scenarios and been prepared for them all.

    You are worried about the vendor going to Miami. I promise you, they are not going anywhere until they have your cash and as no-one else can fill your void, they are just going to have to sit tight and wait.

    They have gone to Miami! And thanks ..... I kinda thought I might have got some feedback here but it is evidently for English people who know nothing about the Scottish system so I will just e-mail the owners of this forum and give them some feedback on the responses I got because it has been a complete waste of time and nothing constructive whatsoever.

    I have bought and sold 14 houses and never, ever encountered anything like this so I am not a novice nor I am ignorant to scenarios which can / can't happen.

    The reason for anyone posting from scotland to say that they are scottish is so that the correct advice can be given not that we just want to help english people.

    If you were in England I would be saying to sue the solicitor for allowing you to exchange without funds in place. People were also stating in disbelief that you had got so far without a firm mortgage offer.

    Evidently things work differently north of the border. I don't know how things work up there but many on this site do.

    You will get help but don't get defensive. People don't mean to upset you but I have never heard of anyone exchanging without having a mortgage offer and I am a mortgage advisor.

    I do feel you pain on the Halifax though. I had two cases pulled for random audit last week and both were cases that needed to exchange within a few days (repossessions) I was lucky and through begging and pleading I managed to get the head office to check the mortgages and offer the same day as referral (litterally was crying down the phone at them as on one of them a cash buyer had offered 4k more and my client would lose the property unless the mortgage was offered that day (got that one offered within an hour of referral)

    Halifax are very slow at the moment. I wonder if there is a pattern of urgent cases getting chosen for referral. Any other brokers finding this?

    Gosh, I cannot believe how childish and rude people are!! Imagine if this had happened to you, wouldn't you be very stressed and want some sensible advice instead of criticism? The conveyancing laws in Scotland are ridiculous, which means it's a nightmare for the OP.

    Mr B who is a solicitor in England / Wales (not saying where!) so is unable to help you because the law is so different in Scotland. If this were England / Wales the solicitor would not have exchanged until the formal mortgage offer had been received - if I read your post correctly, you had not received one before exchange of missives ("contract" in E/W). Unfortunately I doubt anything can be done today anyway.

    Irrespective of the difference in law. The point at issue seems to the completion date. Which appears to have been driven by the OP having to give notice on the rental property and the vendor going on holiday. Which as now has transpired was not adequate time for the offer to be processed.
