I really need some advice about constant harrassment I'm getting from Payday Express. I took out a £150 payday loan with them and couldn't afford to pay it all the first month so I rolled it over to the next month. Unfortunately I then got diagnosed with multiple sclerosis before I could pay them back which meant that I couldn't work so I couldn't pay them back. I've sent them numerous emails asking for a repayment plan and explaining that I couldn't phone them as the MS has really affected my speech. I even sent in all of the documents they asked for before they would accept a weekly payment plan but now they're saying they haven't received them and the amount I owe has now gone up to £700!! I'm currently in hospital with my MS and today I've had a text from them saying that someone will be coming to my house within the next 3 days. My sister rang them to explain that I'm in hospital and asked them to email me to discuss it. All they have done is email me to say that someone will be calling to see me in the next 3 days if I dont phone them. I've emailed them back to explain again that I cannot speak, would like to pay them weekly, and that I'm in hospital but all they've done is send me another email saying the same thing!! I really don't want them going to my house, my mum is there looking after my children and she's at breaking point with the stress of my illness as it is, she will collapse if any more strain is put on her. Can anyone give me advice on what I should do?

Firstly, stop emailing and phoning them, it's pointless (as you are finding out).
If they ring, put the phone down immediately. Ignore the threats they are making.
Send a letter by Recorded delivery to them making them an offer of a repayment plan. Also instruct them you will ONLY deal with them in writing.
They don't have to accept it though. You could try to bolster your argument with a Statement of Affairs (a full breakdown of income and outgoings).
Ring the CCCS for advice, they will likely do the talking for you.
If all fails, your credit rating is already shot to bits so ignore them, let them take you to Court for a CCJ.0 -
Thanks, I'm just concerned that they'll turn up on my doorstep and harrass my poor mum. Any advice on what they should be told if they do call to the house? Am I right in thinking that they can't disclose information to third parties? I just can't believe that they're continuing to phone me despite me keeping them informed of my situation. I've sent them everything they asked for including a statement of my financial arrangements and a letter confirming my illness. I've told them so many times that I can't speak yet they must phone me at least 15 times a day! I'll get a registered letter sent tomorrow and see where they go from there. To be honest I'd rather get taken to court, at least they may show some understanding!0

It's not likely they will turn up, mostly these companies are full of empty threats to scare you enough to start repaying.
If they do, close the door.
You aren't dealing with a sensible, honest lender. These people are toward the bottom of the barrel. They are well used to lending money to people who fail to repay. They have heard it all before.
The amount owed will continue to rise, it's the price you pay for taking out a short term loan with a huge apr, but fail to repay it in time.
Throw the phone away and get a PAYG phone, the calls will not stop.0 -
Thanks for all of your help. I'm just so frustrated with the situation; if I hadn't become ill I'd have paid them their money and to be honest I could probably have found the money somehow but I just got sidetracked with being ill and let things slip. Ah well, lesson learned but I will definately steer clear of shysters like them in future and would advise everyone else to do the same.0

Payday express are useless, and non sympathetic. i anyone turns u at the house, close the door.
They have no business being there, and no doubt will ryhme off a load of old tosh..... id imagine they would turn up and ask for an inventry if they thought thy could get away with it and scare people.Promo codes are never always cheaper..... isnt that right EuropCar?0 -
I would email / write to them stating your repayment offer and then make those payments anyway - don't wait for them to say yes or no. Make the payments through your bank, cheque or postal order. If they accept your payments they are as good as accepting your offer. It also shows you are sincere about your intentions and makes them look unreasonable. Base your repayment on the original figure you owed.
Tell them they are not entitled to enter your property without invitation and you are not inviting them. You wish all contact to be made in writing due to the fact that you are currently hospital bound. I always say i do not discuss financial matters on the 'phone. You need to have evidence of everything anyway to cover yourself and in case you need to make a formal complaint at a later date.
At a later point you can ask them to clarify exactly what the additional amount is for that they've added to the final figure. There is a piece of legislation about unreasonable interest charges. If i can find it i will post a link for you.

I'm sure they'll try anything, and I wouldn't put anything past them. I know I owe them money and I've offered to pay as much as I'm able but they just keep on adding interest and demanding the full amount. I could understand if I was ignoring them and refusing to pay anything at all. It's just so frustrating!0 -

Thanks; I think the best way to pay them is by postal order; it may cost slightly more but I'm actually afraid to give them any bank details! They did actually take a lesser amount from my bank despite me telling them that I was having problems paying - Luckily for me (and I can't believe I'm saying this!) I had my purse stolen and the card that they were using was stopped so they couldn't take any more although it didn't stop them trying! I'll get my mum to post a postal order with the registered letter tomorrow; hopefully that will sort the problem but I'm not holding my breath.0 -

Snap! I had my purse stolen at the weekend. At least you have a positive if they can't take money. Every cloud and all that!!!
When you write just be straight to the point and TELL them what your plan is. If they continue to be unreasonable then you ask for a copy of their formal complaints procedure and show them you mean business. Just be sure to keep up the payments you have offered. Make sure your mom keeps the receipts for the postal orders. Attach the receipt to copy of the letter that you send and keep EVERYTHING!! It's all about the evidence.

they wont be on ur credit file anyway so I wouldnt worry. their 1 of two that ignored my letters so i ignored them and they went away.
why pay by postal order?! its long winded and expensive (po fee, envelope, stamp, e.t.c). standing order or a payment card. (they all do them they just refuse to offer it). u have to push for it, like they push for ur card details.0
