    Hello again!

I've called the gym today and spoke with a senior representative.

I've tried to find a way to "meet half way" and they agreed to change the name on the contract.

During my conversation I also explained that I was willing to pay but certainly I wanted to receive a service for what I pay.

So I have few days to find another person for the contract.

Just wanted to report this in case can be helpful for others.

    :)

Thank you all for your replies.

Olbas_oil, two days ago the girl that did all the subscription for me, called me saying they cannot cancel the subscription.

However, I've realised that my relative, whose name is on the contract DID NOT sign the contract (he was not even there and not even aware I was buying that for him).

So I believe the contract itself is not valid, although I may be liable to pay the subscription anyway, but if the contract is clearly not valid, as I can not sign a contract for someone else that is not even there, that IMHO the entire contract is NULL.

Clearly, regardless of my ethusiasm about subscribing my relative, they should have NOT accepted the subscription without this person signing the contract with full agreement.

Any opinion on this? I'd like some opinion so I know what to tell them.

    Many thanks!!!!

I'm not clear whether you have already paid, or you are concerend that they will try to enforce subscriptions for the next few months.

If you have already paid, then they appear to offering you the equivalent of a credit note, which someone else can use to join (and presumably refund you). I think that's about as good as you're going to get.

If you are more concerned about future payments, then I'd pursue the line of this being an unenforceable contract. If the contract is between the Health Club and Mr Relative then your signature at the bottom is irrelevant (unless you have power of attourney!). If it is between you and the Health Club ( to provide membership for Mr Relative) then you are bound by what you signed.
