    No, wait for them to contact you and when and if they do, post up here what is said to get further advice:)

    To reiterate what was previously said about Mackenzie Hall, if they are involved then its 99% certain that this is statute barred:)
  • We are still waiting on any evidence from them, all we've seen is his signature on an agreement dated previously to the SB six year period. I guess we wait.

    I understand how frustrating this can be, but breathe :)
    Ignore the agreement, they need to show activity by your other half within the last 6 years. Stick to your guns and to any further correspondence you stock reply is that you do not acknowledge the debt and that you believe it is statute barred.
    If you are desperate to get closure, you can try by writing again, confirming the above and requesting acknowledgement and confirmation that the account is now closed and no further action will be taken. Request a reply in writing within 28 days, and state that no reply will be taken as confirmation that the case is closed - and send recorded delivery.
  • They keep sending the same response letters with no detailing on the debt, what should I do now???
  • If they had any concrete proof, they would have sent it by now, so don't panic:)

    What they're trying to do is pressure you into admitting the debt as they've received your SB letter and all they have is some dodgy old credit agreement which is probably more than likely Unenforceable anyway!

    There is a letter somewhere which is what you send off after you've sent the SB letter if these lowlifes still persist in chasing you, I will track it down and post it here for you.

    Lastly please ask your partner to kindly stop phoning them, you will achieve nothing by phoning them, all correspondence is to be via letter:)

    Final Response - Statute Barred


    Dear Sirs,

    Account No: XXXXXXXX

    I recently advised that this account was statute barred, something you still fail to register. You may now consider this my final response, unless you can provide proof to the contrary then this account is statute barred and I shall no longer communicate with you regards to it.

    There has been no contact between us for over the prescribed period and therefore I have nothing left to say to you, if you would like to start action then please feel free. I will submit a detailed defence and also notify the court of your abuse of process and ensure a counterclaim is forthcoming. Your initial claim would be rebuffed as unlawful and vexatious.

    I therefore do not expect to hear from you again, regards to this account. If I do then I shall be formally notifying the Financial Ombudsman Service of your harassment and ask them to investigate your suitability to retain a consumer credit licence, something I do hope we can avoid.
