Help! Parking permit fell off and I got a pcn

hi,
I have a parking permit to park on private land outside my rent property which unfortunately fell off my dashboard.
The permit scheme is run by a residents association and enforced by Gemini Parking Solutions and when I signed their form it said I agree to their terms and conditions which says I must display the permit.
However no where does it say I could face fines of more than £100 just that "failure to do so may result in parking enforcement."
(I might also add they were meant to see proof of the V5 which they haven't - so could that make the contract invalid?)
Anyway I unfortunately did not read the threads before sending my "appeal" where I enclosed a copy of the permit and assumed they would be reasonable and let it go.
They have finally responded way past the supposed seven day period (although they said my letter was received more than a week after I posted it first class) and said my arguement is not valid and they have photographic evidence.
They have threatened further charges and debt collectors.
My worry is that as I have signed a residents parking scheme that I actually do have a contract with the enforcers as well?
Any help would be much appreciated.

Simply ignore them. The invoice is not enforcable. Have no further contact with Gemini and ignore their meaningless letters.
But certainly complain to the residents' association.One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.0 -

Hmm..I can't imagine how the permit could fall off the dash..unless of course someone rocked the car ?
But who would do such a thing...I mean what would be the point ..apart from being able to try and blag £100 off the driver of course !!! :mad:
Perhaps you are expected to nail it to the dash!
Personally I think you should probably nail it to anyone nearby who is employed by Gemini..but that's just me !;)0 -
I have always been a bit dubious about people who say that their ticket fell off etc. Earlier this year I parked in S!!!!horpe in a Council car park and placed the ticket face up on the dashboard. I then closed the car door and looked again. Much to my surprise, the ticket had flipped over, although it was still in the same place, and no longer readable as a legal ticket. Presumably this would have made me liable for a fine for not displaying a valid ticket. So maybe these falling tickets stories do have a grain of truth in them.I can afford anything that I want.

You have written permission to park and your actions of not-displaying it have caused them no financial loss.
Simply ignore.said my arguement is not valid and they have photographic evidence.
Yet they fail to argue why they legally think they are owed the money. Odd don't you think?
How does a photo legally entitle them to the money?

I notice that the spelling and rude word police have been busy again. Not a lot wrong with Sc.unthorpe as far as I can see. It's got the best selection of discount and pound shops of any town that I've been to. It will miss T J Hughes if it goes, I think. The prospects for jobs in the steelworks are not good either. I was looking in an estate agent's window and the dearest house listed was about £140,000 or less.I can afford anything that I want.
