Hi,

Can anyone tell me if Barclaycard are allowed to divulge information about my credit cards to the Financial Ombudsman. I thought that this was covered under the Data Protection Act and not allowed. I was told by Trading Standards that I should make a formal complaint as not only my credit card but also a business partners also.

    I suppose it would depend why they had done so and what proof you had that this has happened - can you give more details?

    Its really complicated, so I shall be brief. We are trying to claim back under Section 75 an amount of money from Barclaycard and is going through FOS at the moment. Personal credit card was used for a transaction, but details of business credit card and partner's business card were obtained from Barclaycard. This card was not the subject of the complaint, but personal credit card. Added to this, the business partner was nothing to do with transaction.

    Is there any possible reason this would be relevant to your claim? Did the FOS request the information or have barclay just provided it?

    I have asked for my case to go to adjudicator review at the FOS as I did not agree with the outcome (one adjudicator agreed with our case, the other did not). We had until 30th July to get any new evidence in and then our case would be sent to the Ombudsman for a final decision. I emailed some new correspondence off today and hae been told our case has already been sent to the Ombudsman. Can they do this or does it breach our rightsto have a fair hearing? We have waited to have the whole thing heard since January 2010 so it seems unfair that they are now hurrying it along!

    You would have approached the FOS to adjudicate your complaint against Barclaycard. The FOS will have then contacted Barclaycard and asked them to provide their version of events. As such they would have needed to provide information about your account.

    Barclaycard are only doing what they have been asked to do by FOS and FOS are only doing what you have asked them to do.

    So what is the relevance of the business card, and ANOTHER PERSON'S card, to the claim regarding a PERSONAL card? Unless the OP is not telling us something important then I would feel concerned too.
