iva ex parners debt
hi i need advice. my ex parner who i split with 2yrs ago has got IVA. i have been threatened with a bailif for £5000 . when we were together she applied for a loan and they asked her for my name to be added as a guarentee so i did so as she promised i would never have to pay a thing. she got the loan and bought her nice car with it. Now they are after me for the payments. i think she has done this on purpose as i have a mail saying she would ruin me one day. what can i do. i know she ownes a house and a car, goes on holidays all the time , kept all our bought goods and yet i left with nothing but my clothes. please help!!!

Hi there and welcome. Sorry to hear of the problem.
Ethics aside, if you signed as a guarantor then you are legally obliged to pay the debt if she has defaulted.
Perhaps she has not paid for the holidays, house, etc herself, but has a new partner who is paying for these things. Either way, if the Bank she borrowed from cannot get repayment from her, they will pursue you.
Normally when you sign a guarantee you have to have it witnessed, to ensure you fully understood the ramifications of what you were signing, and weren't signing under pressure. Did this happen? If not, you may have a case for claiming you were unaware of what you signed (if you even signed it) but if it did then unfortunately you're stuck - her promises of you not having to pay are worthless.
Bear in mind, however, bailiffs cannot force entry for bank debts (only council tax) so if they turn up, don't let them in, or even open the door.
Good luck!Before you ask, yes, I work for a bank, but no, I didn't get a bonus!0
