Only advice I can give on this is to regularly chase Direct Line who are currently handlig your case for you. It's a bit late to switch to claiming from the third party.

How these claims offices seem to work is they will basically do nothing until something comes in relating to your case such as a letter from the third party insurance or a call from yourself, so to actually spur them into action to do anything or chase anything you need to keep calling, minimum once per week.

(SIGH!) The excess is an 'un-insured loss'. Unless the OP has legal protection cover, DL may not recover it.
    PLEASE NOTE
My advice should be used as guidance only. You should always obtain face to face professional advice before taking any action.
  • I thought the issue was the OP (in car B) says C ran into the back of B and pushed it into A thus it's all down to car C

but, the driver of car C is saying that B ran into A before C hit B thus B is responsible for the damage to the front of B & back of A and C is only responsible for the damage to front of C & back of B so B loses excess & NCB

Further complicated by the fact that A is denying being hit at all

a nightmare to describe and I suspect even more so to sort out

Even that take a little time for me to get my head around and I have explained this numerous times to direct line, but yes, you have it in one!

Thank you all for replying, sorry I have not replied before now.

I have pictures of the damage caused to my vehicle which were taken in the police car park after the accident, unfortunately the accident happened on a busy main road at 5pm and we were asked by police to move the cars asap to keep the road clear (The accident just happened to be directly outside a local police station!)

As soon as the accident happened the car that I was shunted into drove off. The only reason we had the licence plate number was due to the police woman who wrote it down. HOWEVER when reporting the accident DL asked what car I had hit, to which I replied "an electric blue peugeot 206" (I was 100% positive as it was the same car we had traded in a few months ago!) and was told that was not the car that was coming up on the system, and upon further investigation the licence plate number is apparently registered to a BMW 3 series (slightly different!) therefore I do believe this may be the reason why they are denying involvement in the accident!

As for the TP who drove into me in the first place, he is claiming that I had to break sharply and hit the mysterious peugeot/bmw hybrid then he went into me. However, at the time of the accident he did say "one minute I was changing the radio, the next minute I looked up and you were there!" and he also called me whilst I was on the phone to Direct Line asking "can they hear me" and then tried to persuade me to blame the car in front and "not to accept liability". He's just an all round w****r!

We do have legal cover, which we are currently going through to claim for whiplash I received due to the incident (I know there's a ridiculous whiplash culture and people magically develop it after being flicked on the ear, but I did have to have numerous xrays and a week off work after the crash) is it possible to add the £600 we are out of pocket to our claim for the injury? Or would this be a seperate claim?

Sorry this is long, people on the forum seem to be the only ones who can give me any good advice on this!
  • Oh, also, to make matters worse, the 'witness' to the accident that gave their details, now doesn't want anything to do with the crash and "wants to be left alone" thanks mate!
