    Hi All - another question. If given paid garden leave (3 months) and redundancy money can the employer pay you each month as normal and then the redundancy on the final salary (i.e. you have to wait 3 months for the redundancy) ? If this is the case does this mean you would still be under contract and therefore cannot start a new job (presumably you won't get a P45 if they intend to carry on paying). Can we request all monies are received in one lump sum ? Holiday, garden pay (PILON?) and the redundancy ?

    The redundancy is not confirmed until the last day, and you may find or be found suitable alternative employment in the meantime with that employer, or you may resign due to finding another job. So yes they can do it and no you can't have it all at once.

    And gradening leave isn't PILON - you are still under contract and can be called back into work. At the drop of a hat. You must be ready and available to work for your employer - so no sneaking off on holiday unless you book it - you are still under full contractual terms!

    Thanks both. So PILON is completely different to garden leave, I didn't realise this. So if PILON you would cease employment immediately and be free to work elsewhere but garden leave you can't take employment elsewhere unless you resign (and forfeit any redundancy). Bit of a spanner in the works then ! Incidentally, decision has been made - redundancy is a certainty. Just means we have to hope any job offers are willing to wait 3 months (or less, by the time interviews, selections, offers etc).

    I assume you can't request PILON instead of garden leave ? That is down to how the employer wishes to do things ?

    I wouldn't suggest it. I would start researching counter notice. By the time she gets a job, if she gets one before her notice runs out, then it will probably apply. Plus, you never know - a jon with her employer could come up in three months - with PILON she is finished and that would be tough luck,
