Hi, Ive just sold my OH's car on ebay, the auction ended this afternoon
This is what I put in my description
PLEASE READ MY TERMS FIRST.
I'M A GENUINE, HONEST AND TRUSTWORTHY EBAYER WHO TREATS PEOPLE WITH CARE & RESPECT, I ALSO ASK FOR THE SAME IN RETURN.
THIS IS AN UK AUCTION ONLY - NO TIMEWASTERS - GENUINE BIDDERS ONLY PLEASE, AND THE WINNER IS TO COLLECT THE VEHICLE WITHIN 3 DAYS OF THE AUCTION ENDING - PLEASE NOTE - THE WINNER IS RESPONSIBLE FOR THE COLLECTION OF THE VEHICLE.
THIS IS A NON-RUNNER, AND MUST BE TOWED AWAY, SOLD AS SEEN - AS SPARES OR REPAIRS ONLY - NO RETURN
VIEWING IS WELCOME AT ANY STAGE DURING THE AUCTION, BY APPOINTMENT ONLY, SORRY - NO TEST DRIVE CAN BE OFFERED.
Your bid is a contract, Please be sure before you place a bid. I wont be held responsible if the item is not required or unsuitable once the auction ends. I do report non-payers & timewasters and will leave NEG feedback.
I WILL ACCEPT CASH ON COLLECTION - NO £50 NOTES
simple & easy terms to follow - thankyou for reading
Came home to find the auction had ended, and then a message from the winning bidder, saying his wife placed a bid then realised the fault with the car and its no longer suitable or required
I no it can be a genuine mistake, but surely my TERMS was simple and easy to follow
Am I within my right now to leave him negative feedback.
Any advise greatly appreciated
Thanks

If that's your ebay advert, the terms are easy to follow and understand, you are entitled to leave neg feedback and then offer the car to the next highest bidder.0

If it's a geniune mistake then I wouldn't leave negative feedback. If you can't offer it to the next highest bidder you could ask them to meet your fees though as you are out of pocket by their mistake. I think this is reasonable. If they had turned up to collect it and then changed their mind and the car was as described then I would leave negative feedback.
I've sold a car on ebay and found it the most painless way to sell a car. I was totally honest of all faults and I offered any inspection prior to bidding but 9 people bidded without seeing the car. The eventual buyer travelled over 200 miles to collect the car, handed over the cash and drove off. :T The other side is my nephew 'bought' a van on ebay. It was a short listing and there was no time to inspect it before bidding. He went with a car mechanic to collect the van and it wasn't at all as described. It had numerous faults not listed and not worth the money he had bid. He didn't go ahead with the purchase. He won't bid unseen again. Lesson learnt.

How long beofre the auction ended did he (or his wife!) place the bid. if there was a considerable amount of time then they could have made some effort to contact you, or even have cancelled their bid.
I'd leave negative feedback, as this will leave you out of pocket and will cost time and money to sort out (re-auction, second chance offer, etc...).
Good luck and I hope you get it sorted.0 -
Ask them to come to some arrangement on fees, if they are willing to do that then I would think there is no reason to leave a neg. If they don't then you should probably leave a neg but as a seller it will hurt you and if they only buy it will have no effect on them whatsoever (unless they are newbies).
Its really upto you though if you have a high level of feedback one neg won't hurt.0 -
Wait the 7 days file non paying bidder report, after further 7 days or so when eBay refund your sellers fee leave him the negative feedback0

Hi
Many thanks for your responses
I have been lucky enough to offer the car to the 2nd highest bidder, and they have purchased the vehicle.
I think at the time it I was just frustrated. Hence this thread, and usually I am pretty laid back and accept these mistakes made by others
He did contact me (apparently when the auction was still live), but of course, being a family, we wasn't at home for the auction ending. Surely if he realised the mistake he could have re-tracted his bid!
His f/d is 23 with 2 negs 92.6% member since April 04- mine is 1074 1 neg (not shown on the score chart) and 99.9% and a member since Dec 04.
I'm still tempted to leave them Neg feedback, but TBH - its not the worth hassle no more.
The car has been sold. So end of

Strictly speaking, he did the right thing. He didn't have a valid reason for retracting. (Your listing didn't change, and he didn't bid the wrong amount)
'I didn't read the listing correctly' is not grounds for retraction... so he was correct to ask you to cancel his bid.My TV is broken!
Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j0 -
I would say he should have retracted his bid. A lot of bidders do not want to retract as a 6 monthy retracted bids tally is displayed on your feedback page. It would be a lot easier for them if the seller cancels the bid.0

I would always ask them to pay any fees that were incurred and any disputes would be dropped.
Otherwise they would receive a NPB strike against their account and a Possible Neg feedback depending on how I feel, and ho truthful I think the person has been.0 -
I seem to remember that if both the seller and bidder decide not to go ahead with the sale, the FVF is refunded and the bidder does not get an Unpaid Bidder strike from ebay.0
