Zavvi not supplied goods

Bought some items from Zavvi took payment on day of purchase. Still not dispatched 14 days later. Even though at the time of ordering, it stated in stock, dispatch within 24hours. Now this is not the first time.
Also has previously happened with The Hut.
You also cannot cancel the order because the system, states awaiting dispatch too late to cancel etc. I send them messages they ignore for days on end or fob you off with excuses delaying tactics.
I would like to know legally where you stand with this. Surely there is laws that they are breaking by taking the payments. So long before dispatching.
This is really starting to grind on me now. I would like to quote chapter and verse at them if there is one.

    You have to wait a month for delivery by law.

    However if you have emails stating the item had been dispatched or other emails to show they stated the item was in stock, particularly if they are a small retailer, you can threaten to report them to their local trading standards for misleading you on their website.
    I'm not cynical I'm realistic :p

    (If a link I give opens pop ups I won't know I don't use windows)

    Have you thought of phoning them. Sometimes actually speaking to a person gets these matters sorted more quickly

    No you don't Under the DSRs the OP has the right to cancel the order even if its not been dispatched for a full refund.

    Possibly confusing that the seller should aim to conclude the contract in no more than 30 days with the customers rights?

    As stated above, customer can cancel for any (or no) reason prior to delivery and not be out of pocket a penny. They can even refuse delivery and it cannot be seen as a breach of contract. They should be refunded in full - including delivery costs if they paid them (unless they ordered more than 1 item and the other item/s were delivered).
