Under the The Consumer Protection (Distance Selling) Regulations 2000, they are not allowed to charge you a re-stocking fee. You are entitled to cancel the order within seven working days (i.e. not including weekends and public holidays), with the first day starting the day after delivery. However, as this was not actually ordered, the responsibility of paying for the return postage is theirs.
Do the DSR apply when buying from a company based in Germany?

They apply when buying form any European Union based company.

One of the big exceptions is anything that is custom made though.

There is nothing in the OP's posts that says teh item was custom made. I doubt it would have been possible to just order a custom made item in the way the OP has described. Just because he had to have the item made in the UK, does not mean that he item was not off-the-shelf in Germany. However, seeing as he didn't actually order it in the first place, the DSRs still apply.

The company is likely to be upset as the part has been manufatured specialy and will not be a common order.

Last paragraph, specially manufactured = custom made in the eyes of the law (they've made it to order, rather than it being an "in stock" item).

However if he didn't actually place the order (pressing the last confirm type button), he shouldn't have a real problem.

The question I'd have is, was the site in English, or German, and if it was in German how good is his German.
  • Another point to note is that the OP didn't state for definite that they never ordered the part, only that
I am pretty certain I proceeded no further than this and then closed the web page.

"pretty certain" but not 100% certain.
