Companies and people can be very petty and they have long memories. I can't imagine them giving your application a second glance, except to maybe giggle over as it's passed around the office. But you've nothing to lose if you really want to have a go.0

LOL, since when has forgetting to bank a cheque been an offence.
If it is, our prisons would be full of unemployed Financial Controllers. There cannot be an office in the land who hasn't managed to bank their cheques daily on ONE occasion.0 -
You could apply but as to whether they would want you back is unkonwn but i imagine they wouldnt.0

mountainofdebt wrote: »About 2 years ago I posted on here how I had been suspended from my job at that time on a gross misconduct charge.(The charge was that I hadn't banked some cheques received)
The charge was upheld (I admitted it as there was no way it could be denied, lol) and although I took it to appeal, I knew it was just a formality and that there was no way in hell would I be reinstated.
(Intereresting enough the person who initiated the gross misconduct proceedings left the organisation shortly afterwards - I don't know if it was co--incidence or whether issues that were relevant to the case that become knowledge to the board meant that they walked rather than pushed .....all I know is that they left.)
So started 6 months of hell - confidence rock bottom, which meant my performance in roles wasn't fully typical and debts couldn't be paid off and ended up having to agree to reduced payments. The road to recovery began when I got my present role in which I've been praised in and performing really well
However even though life is a little better the pay isn't exactly brillant and I really want to clear my debts quicker; I have a 2nd job which tbh is looking shakey so have been looking at the various job sites to see what's out there.
So I see an advert for my previous role, paying alot more money than I'm currently on. I'm torn between applying for it and not -part of me thinks what the hell - I was good in my role and my only crime was not to bank some cheques once and the punishment handed down was certainly disproportionate and its ina sector I would love to return to, but the other part thinks why bother as I doubt I would get an interview, especially given my history with them and I know I ruffled a few feathers by challenging the processes (in a nice sort of way, lol)
So what would you do ?
For this reason I see no harm in reapplying, they could say no, but then they might actually have been happy with the work you had done while there. Go for it if you can continue working there after this negativity and I wish you all the best.0 -
So did you take your case to an Employment Tribunal to complain about these injustices and ride majestically to victory with a massive compensation cheque? Thought not.
Yes I am serious. You committed an offence and were punished for it. Your argument is a bit like the 'I only stole 10p' one. You were responsible for the company's banking, failed to do it, interrupted the company's revenue stream and whether it was a few cheques for one day or not, the company were entitled to dismiss you for gross misconduct and no Tribunal would have said that dismissal was outside of the range of reasonable responses.
You may think you 'ruffled feathers' but in the end you were sacked. For gross misconduct . That is all your personnel record will say. Anyone who thinks they have a cat in hell's chance of getting a job with an employer after that needs their head examining.
Believe me if I could have taken them to an ET I would have but being there less than a year meant that I couldn't.
I never said I shouldn't have been punished - I said that any REASONABLE person would have given a more reasonable penalty. It was a well known fact that the person was wanting to make an example of someone and I was later told that following my appeal (and what came out during that meeting) there were rather a few heated conversations between said person and their bosses- but there again that might again have been all co-incidence, who knows.
Also I don't think I ruffled feathers I know I ruffled feathers. And as for the getting another job guess what I did ......and am still in that position. Or couldn't you see that bit of my OP whilst on your high horse?
At the end of the day, you're probably right - I probably don't have a snowball's chance in hell of even being shortlisted and I don't know why I'm even thinking about it. But there again people have been called mad before but proved to be perfect sane.2014 Target;

I say give it a go. The worst that can happen is that they say no. If you don't ask, you don't get. You obviously didn't do anything really bad or you wouldn't even be considering re-applying. Forgetting to bank cheques is obviously a nuisance but it is hardly the crime of the Century and you didn't gain by it.
Now the nasty cow who instigated this procedure has gone, go for it. If it's a 'no', then fair enough, but at least you have tried.0 -
Whatever you choose to do good luck with it.0

Ditto. Even if the person you speak of has left you don't really know who said what and how/why so at the end of the day what matters is you were sacked from the company. That's all that will be considered in the reality of it all. There's an old saying never go back and to be honest you a mighty cheeky to even think they would even consider you, you were sacked and as such they wouldn't want you back in any circumstance.0
