Must admit that, in those circumstances, I'd be googling for "treats hens love" and wondering if the cockerel might be tempted enough to cross over the wall to get some if it was lying around....and hungry enough to venture out into that road to get some more....

But then - she was being antisocial to have a cockerel there in the first place and sounds like the type of neighbour that will put peeps through all sorts of hoops to get officials to deal with her....so if she has one that cant resist "goodies" the other side of the wall then...

A vegetarian suggesting animal cruelty, that's just disgusting.

AFAIK yes, the covenant is between the original owner (council) and the current owner (you). When you signed the contracts you took on all rights and responsibilities associated with the property. These covenants are frequently unenforceable because the original owner cannot be found, e.g. the local bigwig and landowner back in 1813. :p Do you know what the specific wording of the covenant is? Can you definitely not keep any number of chickens as pets or is it more about smallholding or breeding?

You could try to get the council to lift the covenant but I don't rate your chances: councils don't like change and would want you to pay all their AND all your legal fees. You might just go ahead regardless if you are confident none of your neighbours know about the covenant and none will report you. Might be worth you searching/ posting on the House Buying, Renting and Selling board, covenants of this nature have been discussed before. :)

Thanks for that FireFox :) Unfortunatly we don't get on at all well with our neighbours one side, they'd love to get us into trouble. I don't know the precise wording, but it does exclude all poultry unless permission is granted first. I can't see that they'd refuse given that we have chickens in the garden directly behind, so the noise would be no different (they have a cockrel, but I wouldn't have one, I want eggs to eat, not for babies ;) ). Wouldn't hurt to ask I suppose

  • Next time it wanders into your garden, you could clip one wing on each bird and then put them back into her garden. It makes it harder for the bird to escape because they're off balance.

But only if you know what you're doing or the bird can bleed to death.

Update on the situation. Just had my landlord on the phone (we rent privately) to say he has had a recorded delivery letter from this neighbour complaining about the fact that I mentioned on facebook that her cockerel woke me at 6am on a sunday morning. It and the chickens keep escaping from their pen and are in the road and our and our neighbours garden.
My landlord is not very impressed with the letter although he has said he will keep out of it. He has said we are good tenants and he wants to keep us (which is nice) but he will ring her and tell her that its nothing to do with him.
What is the best way of handling this as I am now fuming..... Shall I get CAB to write a letter to her about this, cannot afford a solicitor as on a limited income and my local solicitors do not do legal aid for neighbour disputes.
  • How can she complain about you commenting on something that actually happened?! Is she denying that her cockrel crows? Block her from your facebook (you don't have to already be friends to do this) as a starting point.

i dont understand how she saw your facebook ?
  • Anyone can look at your facebook if you do't set it so that they can't. You should set it so that only people you have accepted as friends can see your info.

I'm not friends on facebook with her. Didn't even know she had a pc. I wondered if it was the girl who lived here before we moved in that had told her. She is friends with me on fb as our children go to the same school and we get on ok. She has made it known she wants to move back to this house. She commented on my post and I wonder if she went to this neighbour and told her to try and cause trouble with the landlord.
