No tenancy agreement - notice period?

Hi there,

Just wanted some advice. I'm currently renting a flat with a friend. We moved in last August and agreed to stay for a year. Since then despite asking a couple of times We have not had a tenancy agreement.

There have been a few issues with the flat but on the whole I like my landlord. Can anyone advise me what the normal notice period for moving out is? Would a month's notice be fair. Could I say on the next rent day that we are leaving and you have four weeks, so this will be the final rent payable?

    In England a tenancy agreement does not have to be written, but clearly verbal ones are difficult to establish what the terms are..



    You can leave at the end of the initial term without any notice, but agreement would be sensible. After that the tenancy rolls on month-by-month, and a minimum of one month's notice is required, notice ending at end of rent period.

    (eg if tenancy started 10th Aug 2010 for 12 months to 9th Aug 2011, if notice is given 24th Aug 2011 it would expire 9th Oct 2011).

    I suspect of Landlord wouldn't give tenancy agreement he's probably "forgotten" to do various other things?? - Gas saftey certificate, deposit protected as required, proper insurance, declared his rent income to tax man?? If tax may be an issue you could "suggest" he agrees with whatever date suits you... (get it in writing..) then grass him up to the tax man.
