Renewal of DLA - form received early?

Hi everyone!

Just wanted to ask, my mums DLA runs out in November 2011, however, she received her new form this week asking for it to be filled in and sent back ASAP!

Is this normal for DLA to do? There are still 4 months left on the award...
Would it matter if she sent in back in a few weeks time? (Due to her disability, its quite difficult for it to be filled in quickly and all at once)

Sorry to ask, but this is her first renewal since being awarded DLA

Yes its the normal timeframe and if you take to long to fill it in and return it it may not be renewed in time but saying that she still has a good month + to gather her evidence, fill in the form and get it to them so long as its recieved 12+ weeks before her award ends.

It's normal for renewals to be sent out 4 months in advance.

It takes me weeks to do mine, at least two months, and I never manage to send it in earlier than 8 weeks before renewal. This has good and bad disadvantages because if they decide not to award you, the award may stop from the day they make the decision (in some cases) and not the renewal date.

Alternatively, if they up the award this is also backdated from the day they recieve the renewal. This time they upped my award and if I was well enough to send in the form earlier I would have had a few more weeks backpay but I am not bothered about it.

The main focus was to ensure I filled it in accurately and I won't send a form until it is. One year I was just four weeks before renewal but was so ill, I could do nothing about it.

Sorry Anubis, but I think you are wrong about the award stopping before November if it is decided not to award DLA.

My friend's son received HRM and HRC. His renewal was due early May last year. My friend sent in the form and received a decision about a month before the end date from the previous award. is award had been reduced to zero for both care and mobility. The remainder of the earlier award was still paid, and the mobility car only had to be returned in early May.

Incidentally, the DLA was refused because of a grossly inaccurate report from the child's school. My friend went to appeal and in February this year, HRC and HRM were awarded and backdated.

I am not really doubting what you say but are you 100% sure?

Do you have you any web link reference as it sounds very draconian as they would have to ask for money (already paid) to be paid back.

chocolat2 If you have an Age UK locally they have people who are trained in filling in these forms its free and usually only have to do it once!!

I know on mine I always end up sending it in later than the cut off due to anxiety of having to go into details of my condition. They have been pretty good with me and understanding and put a note that I have developed an anxiety re the forms themselves and allowed me extra time, so although it is for benefit of processing good to get them in asap, they have not penalised me for being unable to face them, instead they were supportive and advised me to seek welfare rights and gave extra time without penalising me. They even back payed me whilst waiting the few weeks till new award.

So depends on wether you keep them informed I believe :)

Well I believe they work on the basis that if you are not entitled anymore determined from the day you send in the form which is what they make some if heir decision on, then they take it off you. However, while I do know someone this happened to, I am not 100 percent sure. I do know they backdate an award from the date the renewal form is sent in if they decide to increase an award.

Similarly, not sure how they would work out the date to cut off someone if they were awarded indefinitely, had a reassessment, then lost. I am sure they would work from the date they recieved the form or the date of decision.

However, did your friend appeal? If they appealed they should have been allowed to keep the car for UP TO 6 months. This may be why the car went back after? Are you sure they still got their HRC allowance too?

My friend appealed and still had to give the car back. As I said in my earlier post, HRM and HRC were awarded and backdated on appeal.

Not sure what you mean? I think it is generous of them to pay the higher award from the day they receive the form? I am 100 percent sure they do this because it has just happened to me. They backdated my upped award from the day they received the form, not the date of renewal. I had nothing to pay back, they paid me.
