    I can see why you think it will provide protection for you.

    I just don't agree. The only part of this which can at all demonstrate his commitment to you / to the sale is to give notice to the tenants. It is not within his power to secure (2). He can only secure (3) at the point of obtaining vacant possession, which might be several months after the expiry of the notice. In any event,I would expect (3) to happen without you requiring it in a signed document.

    You are clearly wedded to this idea and have given the conditional offer. You will just have to wait and see how it pans out.

    Progress: Offer accepted on those terms. Although the seller is now saying that we won't be able to complete until 1 December (we would still progress to exchange as normal but then have a longer gap (I guess 2 months) between exchange and completion.

    Anything to be concerned about?! Obviously I realise that I'll have to make sure that my mortgage application and survey will still be valid...

    Yes. It sounds like the deferred completion is to give the vendor time to get the tenants out. I would not exchange until the vendor had vacant possession of the property.

    Yes, we definitely wouldn't exchange until the tenants are out (and we've seen evidence of that). So it would be survey next week, notice to tenants (assuming all is well) first week of August, notice expires mid-October (ish), exchange a couple of days later, complete on 1 December. Does that look ok?

    Hope it works out for you. My daughter has just lost £1300 due to her seller pulling out on completion day. He refused to exchange beforehand, wanted to exchange and complete on same day. I smelt a rat from day one but my daughter had faith in him! Anyway two days after pulling out he decided to go ahead with the sale, needless to say my daughter told him where to go {in very polite language}. She is now buying a house in a better area and there is no work to be done on it and it is an empty property due to job relocation so everything moving very quickly.
  • nothing stopping you asking for whatever you want, but that doesn't mean the other party will agree to it.

    Not sure I understand. The sale is agreed. The process i set out is what both parties are envisaging - I just wanted people's opinions on it.
