Vent... car accident claim!

So, apparently I had a car accident in August 2008. In September 2009 the company who employs the driver I supposedly hit send me a letter from their solicitors threatening to take me to court if I don't immediately pay. (This is the first point that I am aware that I've had an accident!)

I told my insurance company and they said "don't worry, we'll deal with it".

Fast forward to the beginning of the this year, I had another letter from the companies solicitors, same thing. I phone my now OLD insurance company, same thing, they'll deal with it... but can I prove where I was? Uh... no.

And now I have a freakin' pack of paper telling me that I have to go to court!! So now of course i have to send this whole thing to my old insurance company and hope they actually do something... I'm not holding my breath. :mad:

    The other party must prove it was you who was responsible & as you was insured your old insurance company will have to sort it, & how come it took so long after the accident supposedly happened to report it to you, my son had an accident on country road with just passing places, it was like for like both coming round a bend & both swerved but hit each other, my son did not want to claim for his car when insurance told him like for like cos he did not want to lose his no claims & his insurance is over £1,000 & car worth £400, then he gets a letter off his insurance saying other party had independent witness as it turned out it was his friend & i was able to prove it, now waiting to see what happens.
  • Sent off the court documents to my old insurance company. What annoys me is I told this company that my insurance company will deal on my behalf, but they ignore me and continue to send me threatening letters (wonder if I've got a case for undue stress caused by consistent harassment?? lol).

    People make me angry.
    I'm supposed to be able to prove I was at work at the time of this accident, which was on a Tuesday, so I shouldn't have been at work unless I was doing over time, but our records only go back over a 4 week rolling period, or 26 weeks for absence, either way it's a little late for that.

    I wouldn't have been in the same town if I wasn't at work, but on top of that. What REALLY gets me...

    It was in a McDonalds car park... the OTHER side of town from where I work, which is about a 10 minute drive each way.
    There's another McDonalds within a 5 minute drive, and one which is a 2 minute walk... which one would I choose... hmmm? Considering I only get 3x 30 minute breaks.

    Grrr.

    The reason they've now issued proceedings could be that, if there's an injury claim, their time is up next month. And any court papers must be served on you, unless your insurers have nominated solicitors. It looks as though your insurers haven't dealt with this at all, if they've never even bothered to take a statement from you, or arranged to inspect both vehicles.

    Well, the problem is that it took them over a year to start a claim, a little late to be inspecting vehicles. But this company have ignored anything I've told them (i.e. my insurance company are dealing with you, stop sending me letters).

    The court papers made no mention of any injuries, just vehicle damage.

    The most offending bit of this is... I don't really like McDonalds.
