    Not the same one then.
    I thought for a chargeback you had to have spent over £100 on the transaction, or have I made that up?

    hermum - this one is not the same one as the amazon case,
    sec 77 comes into play when the total value of the good or service exceeds £100 but i beleive you can dispute any transaction.
    i think the credit card company consider each dispute on a case by case basis before a decision can be made.

    That is one definition but you conveniently forget to mention that there are other legal definitions of fraud.

    Frankly with the banks being so stringent with regards their employee behaviour I would seriously reconsider any idea of making such a false statement.

    Please!!! stop being soo pedantic - the issue here is me lost money that I should have use to buy a gift for my kid's birthday.
    i was only stating that as an option so please stop advicing me on what is right and wrong!

    I don't think I am being pedantic, I am trying to offer advice and stop you from making a bigger mistake. I really do feel your pain on this lost money, but work towards a proper response to get it back, don't make it worse by getting yourself into more trouble.

    Is it worth an appeal to ebay or paypal for instance? Ebay in particular have done some no fault refunds before now with no apparent pattern. Play the sympathy card, phone them explain how this is really upsetting you and can they help you as you bought in good faith through their site. They might even allow a claim for non receipt to be opened, it must be worth a try.

    Ah thanks for yoru sweet and kind words soolin but I doubt if sympathy would take me anywhere esp with companies such as ebay and paypal.
    lets not forget that these companies are constantly under the radar form regulators and city watchdog to enforce rules and tighten their policies.
    all this comes at a cost for them and this gets worse when designer labels dont want their stuff to be sold on ebay.
    they will not leave a single oppurtunity to make money and keep their investors happy.
    i have dealt with ebay and paypal in the past and they are mean as hell in such scenarios!

    I am with soo. Sympathy card all the way. If you go in with attitude in your post, you wont get anywhere.

    At the end of the day, you bought without protection, they need do nothing, so a sympathy card will always go further than attitude.

    What have you to lose? You bought without protection so as others have said ebay need do nothingt, Whats the worse thing that can happen if you try the sympathy card> You wont get a refund so you will be in the same position. The best that can happen is that someone at ebay does a no fault refund (they do happen). You have nothing to ose and everything to gain.
