Paypal Chargeback Help Required

I sold a used Thomson Sky+HD Box on Ebay for the Buy it Now price of £54 with free delivery, and I used the Ebay listing details for that model. I knew that buy it now required a 7 day cooling off period so my returns policy was as follows:- Please read before you buy. if you buy this item you agree to these terms. This item has been fully tested by a qualified Elec/Eng, it must be checked and tested on reciept, I will accept return only if faulty. Item must be returned within 7 days of receipt with seal unbroken. The buyer pays for return, etc. It was purchased and I had it delivered the the buyer by 24/48 hour courier, 12 days after he received it he posted feedback as follows:- "One helluva nice bloke! Proffessionally presented item, no complaints". I heard nothing from the buyer until Paypal contacted me 12 weeks after the purchase saying the buyer was claiming a chargeback on his credit card because the item was not as described. (Remember I used the Ebay listing details for that model). I sent all the paperwork to paypal showing every deatail about the sale, now they have charged my account £61 saying it is the credit card company who did it not them. They also say they will continue to sort things out. By the way Paypal waited exactly until the 90 day access to the listing time of Ebay sales expired before they asked me to send a copy of my returns policy, also they gave me 24 hours to return those details, luckily I had copied all the paperwork 2 weeks before. (Strange that was'nt it, remember get all the info together before its to late). I don't believe paypal do anything to fight these cases they just let time pass and give the creditcard company the money back to save themselves hassle, then charge the seller. At this very moment in time I do not have any money in my paypal account just a minus £61-00 (in red) my credit card got damaged and had to be replaced. So they will have to take me to court to get the money, lets see what happens. Regards, Exgreenie

    I've not read it all as huge chunks of text with no Paragraphs I find difficult to read and can cause me Migraines.

    But the jist I get is you have had a chargeback. All you need to defend this is proof of posting. So you need to ring Paypal offer to upload (or fax a copy) to them. You may also need to remind them of their own rules. You always need to keep proof of posting for 6 months

  • Firstly if you are a business seller those terms are illegal for several reasons. Even if you are a private seller I'm amazed someone purchased it as you refuse to cover return postage if the goods were faulty which isn't fair.

    Paypal seller protection would be offered for this type of item, did you send the goods tracked and do you still have those tracking details? If yes then you can appeal and Paypal should refund you and deal with the credit card company themselves. If not then sadly the matter is between yourself and the customer and you would need to contact them to discuss this. It is possible the buyer has requested a chargeback either by mistake or because the goods have broken in the meantime.

    Paypal will use a debt collection company to recover the negative balance if you don't settle this, I would suggest borrowing some money to pay this.

  • 1) I sent it by 24/48 courier, it was tracked, paypal have these details already.
    2) I did not type all the returns policy, but it goes no to say that if the goods are faulty then I would re-imburse payment, if it was not faulty then the buyer paid return. I was trying to save space.
  • If Paypal have the tracking details I would call them and ask why they have not offered you seller protection (unless it took more than seven days from payment to be dispatched or wasn't sent to the address on either eBay or Paypal, as this invalidates seller protection).

  • I am a private seller, this item was in perfect working order, during the 10 years I have carried out 511 transactions, buying and selling, approx 1 item per week, I have 100% feedback, I am pretty sure that Paypal make their own rules up as they go.
  • None of that matters, if you dispatched the goods to the registered address within 7 days and have tracking to prove delivery, you should give them a call and ask them why seller protection wasn't offered. Unless a piece of the puzzle is missing from your posts, one phone call to Paypal and they should credit your account.

    FYI as a private seller you don't have to offer your customers a cooling off period.
