Fake ebay stuff--where do i stand??

I recently ripped our FULL LEATHER setees, and had to get a man round to sort it out, he told me he couldn't fix it as it wasn't leather and it was vinyl.

Now here is my dilemma

we bought them from a seller in july 2007, and they were sold ( checked feedback etc ) as FULL LEATHER SETTEE SUITE.

Now i know times gone by, but if it broke then fair enough, but it hasnt, its fake, and has been mis-sold.
Spoke to ebay, and they can't do anything as its 4 years ago, i knew that was going to happen, i have just this minute sent the company an email.


Any idea if i am flogging a dead horse? or what else could i do?

    Your flogging a dead horse.

    You cant claim under SOGA as you damaged the item your self.

    ebay will be harder - I got 50% back on purchase price on a Furniture Village Sofa set which was missold as real leather - it was 4 years old when they refunded me the 50%.

    You would need to have screenshots of the original ad, information about the seller and more - also I wold guess it was paid via PayPal? If so that would mean any form of chargeback wouldn't be viable...

    He's not disputing he did the damage, his SOGA claim would be based on the misrepresetation of a product material at the point of sale.

    Something which doesn't matter if it was damaged...

    no i dont care about the damage--im not claiming for that!


    if i hadnt of damaged it i wouldn't have known it was fake!! they have just emailed me back and asked for all the details and they will look into it......
