DLA ESA been stopped

Had my esa stopped because I didn’t attend a medical, I never received any letter telling me about a medical, but that doesn’t seem to matter to any body, no one wants to listen, I asked for another one but it was to late, stopped means stopped to these people, when I asked what I was to do for money they told me to sign onto jsa, I asked about a crisis loan, but they told me I couldn’t have one unless I signed up for jsa, if I signed up for jsa I could have a crisis loan that day, I told them I was unfit for work, they said that didn’t matter, I then asked that don’t I have to sign some sort off declaration to say am fit for work and actively seeking employment. I was told yes, so I stated the obvious to them, that they wanted me to make a fraudulent claim, (to claim I was fit for work when I wasn’t) the conversation went drastically down hill after that. They didn’t want to know,
I left the job centre feeling that I had just been blackmailed by some very uncooperative staff, the black mail being if you don’t agree that you’re fit for work you get nothing of us. Being as stubborn as I am I refused and left with no money.
Went and seen a solicitor friend of mine who spent a few hours making phone calls for me. I was told to go back start an appeal, but put in a new claim for esa pending the out come of the appeal, then asked for a crisis loan.
I did just what he said, the staff in the job centre told me I couldn’t make a claim for esa unless my circumstances had changed, so went back to see my solicitor who then told me to do the claim on his phone in the office, when I got through I tried to make a claim for esa but was bluntly told in no uncertain terms that I couldn’t do it, my solicitor then took over on the phone, he informed them who he was, told them this phone call was being made from his office, was fully logged with date and time stamp and was being recorded for legal reasons and could she please explain why I wasn’t allowed to make my claim for esa and why were they trying to black mail me onto jsa. And why were they making his client make a fraudulent claim
The conversation took about 40 minutes and I left his office with a new claim for esa on the books plus a appointment to pick up a giro that day from the job centre for £75 of the crisis loan people because now I had a claim pending I could get a crisis loan. Fine, sorted got a result you would think, don’t hold your breath.
New claim has been in now for over six weeks, have phoned constantly, all mail and certificates have been sent recorded delivery so their would be no misunderstandings their, they have decided that I cant have a payment until ive had a medical, the medical date could take months, so am back were I started, new rules say you can only have three crisis loans, ive had them in the last six weeks so no more.
Back to the blackmail, if I sign up for jsa they will give me money within a couple of days, or I can wait a few months for my medical. What is wrong with these people I thought they were there to help?
I have been disabled since 2002, never claimed a benefit in 20 years before that, always got paid and always paid what I owed, there is no dispute to my disability, the doles own doctors signed me off for life, since this lot got in to power and changed all the rules, they have made my life hell, what is going on people, I remember them going on about cleaning up the scroungers and doggie claimers, and stopping all the fraud, but after reading through a load of forums concerning this subject its obvious that the government is committing the fraud by moving people from one benefit to another, is this so they can claim they have lowered numbers claiming a certain benefit, plus they are now making honest people fraud themselves by forcing them to claiming jsa when their not entitled to it, Job Seekers Allowance its what it says it is, to claim this you need to be actively seeking a job, if you claim it and don’t look for a job your breaking the law.
Well back to the point of this post my solicitor friend told me that this is spot on for a civil action some one should take the jobcentre to court because they blatantly have forced large numbers of people to fraud themselves or starve or get evicted ect ect,
But their not stupid are they, they have picked on the people who cant afford the law, he checked it out for me and you wouldn’t get legal aid for it but if enough of us get together as a group there are companies out their who will take the case on depending on the numbers I can get together.
So who’s up for it, lets all stop just talking about how were getting stiffed, lets get together and do something about it. Not sure how am supposed to go about it but collecting name and numbers has to be a start, have already applied to a few firms to see their response.
And just because you have had your claim sorted out and everything is good now doesn’t stop you participating, if you were forced to claim jsa when you weren’t fit for work this is for you to.
So please post if your interested and also if you have any ideas on how to proceed.

OP talk to the disability alliance they have already started the early stages of legal action regarding cuts to disablity payments0 -

spent nearly 20 years in the armed forces came home with my legs blown clean off, done several bits and bobs since I came home but not many people want a wheelchair or a very wobbly man around, its people with your attitude to them les fortunate that make this process so bad, you need to give your head a shake fella, comments like that aren’t very constructive, didn’t realise I got my self on a !!!!!ing forum, the idea was to get genuine people together in the hope that them in charge stop shafting those that need their help, I know theirs loads out there that don’t need it, but that doesn’t mean they can just blanket every one dose it, honest people are being made to suffer unnecessary just so a few politicians can claim there doing something. if you got nothing nice to say why bother opening your mouth0 -
Umm have you asked them about retraining for maybe admin work?
My OH is wheelchair bound and is currently doing an ECDL as he obviously can no longer herd pigs. Quite a change for him from farm to office but he is managing and he feels better for it. (He also spent time in the army, he turned 18 in South Africa during the apartheid era and had to do national service. Not a pleasant experience. Managed to get out when the British Embassy gave him a UK passport)
As soon as he finished his course he will have a job at the local school.0 -

Silly question, but aren't you getting a War Pension? Loss of both legs would probably entitle you to;
1. 100% War Pension
2. War Pensioners Unemployability Supplement
3. War Pensioners Mobility Supplement
4. Severe disability and comforts Allowances
5. Also you should be getting a Service Attributable Pension (Tax Free)
6. You would also be entitled to DLA on the care side
7. Depending on were you live and housing situation, most councils do a 100% disregard on your War Pension, so you would get housing and council tax benefit.
No reason for you to be claiming ESA or JSA, the War Pension isn't great, but it's much better than the benefits you are trying to get mate!Opinions are like bottoms - We all have one, just some stink more than others

Bit confused as to what is going on, put a post up asking people if they wanted to stand up and do something about the way things are going, as there is always more clout in numbers and now am under attack.
Giving people advice, do this do that is great if the people in charge play by the rules, but in a lot of these cases they don’t. so it takes some people to make a stand to put an end to it, British law is filled with test cases that have changed legislation and forced governments to back track on policy or decisions made.
what has my credentials got to do with it, it is a perfectly good post giving information and circumstances, asking have you been through the same and if you have do you fancy doing something about it, why the hostility, you either want to get on board or you don’t,
don’t see why I should answer the character assassination as it is totally off the subject to the post in question, but as I am a very confrontational person I will bite this once, it was my fault my legs got blown off and I was drummed out (dishonourably discharged) I was lucky not to end up with criminal proceedings, I suppose it was my 20 years good service plus the fact that I was the only one injured that I have to thank for that (no charges) I will pay for my neglect to my job for the rest of my life, and the only thing that I am thankful about is my neglect didn’t hurt anybody else. So for all you people who know about this stuff, it means I don’t get anything of them.
As for the ecdl, done it and the advanced, but any kid with Microsoft office pack on their computer could do it, another cornflake box qualification that lets people know you can turn on a pc, type a letter, put a basic formula in excel, make a few pictures jump around the screen in publisher, and you can keep track of your cd’s in data base, never did understand why they called it a driving licence, spent years around pc’s and never found one I could drive. Also pretty good with html, java, php, know my way around servers a bit, Perl, apache, MySQL, htaccess, CGI, secure ftp. Linux or windows, no expert by any means but with a domain name and a hosting package I could throw a forum up just like this in about twenty minutes using something like, simple machines, phpBB, bbPress, PunBB or Vanilla Forums.
So now we have established that’s its my own fault ive got no legs, and even though am no expert I have definitely got enough grey matter in my head to do things, any chance we can get back to the post in question, and can we stay on target, I didn’t asked for advice because I have a solicitor and the CAB for that, I know am not getting evicted my house is paid for, I wont starve and am not desperate witch makes me a lot luckier than some of the unfortunate people I have read about, but I am p**sed off at the way I have been treated, and as I live in the UK I have the right and the ability to do something about it, that’s my right.
Now ive given more info than really required I hope your satisfied, don’t really care if your not, but in future I will only be reapplying to threads concerning the subject matter, and I would respectfully ask that every one else dose the same, thanks People.

Who also claims to be a benefit advisor, and your response to someone who is claiming to be in dire straights is not how to address the issue but to get a job?
