DRO & Living Abroad

Hi all,

I'm trying to get my head around part of the requirements list to applying for a DRO.

"The debtor must be domiciled in England or Wales, or in the last 3 years have been resident or carrying on business in England or Wales."

I'm a UK Citizen, born and bred in England, but for the last 3 years I've been living abroad under a tourist visa in a foreign country outside of the EU. All of my debts are in the UK and my work is also based in the UK (I work remotely via Internet). I complete a UK tax return, but just haven't been living in the UK.

I understand that to apply for a DRO you need to have either lived in the UK for the last 3 years, or be domiciled. I don't understand if I would come under the domiciled category, since the UK is my home country and my sole country of residency.

Can anyone help with this question? Thanks!

But you mentioned you live abroad? where abouts? Scotland? or somewhere more exotic?

You must have had a fixed address in England or Wales in an exact 3 year period prior to your DRO being submitted, so if had a DRO submitted today, you must have lived in England or Wales at some point since 6 July 2008

Thanks for writing back wba31.

I noticed that the paragraph I quoted above was actually from what they thought was going to be the guidelines. The actual guideline according to the insolvency website is:

"You must be domiciled (living) in England or Wales, or at some time in the last 3 years have been living or carrying on business in England or Wales."

So maybe I still will be able to apply for a DRO since I was living in England 3 years ago, but haven't been there for over 2 years now.

Just an update for anyone who may be interested in this. I spoke to CCCS today and they confirmed that I would be eligible for a DRO given my circumstances as I have lived in the UK at some point within the last 3 years.
