Your boss doesn't have to offer you this, and you don't have to do it if they do. It is upto you to agree between you if this would be helpful and, if so, what you should be paid.

    You cannot work for another employer during your leave, but you can do self-employed work.'

    As a slight drift, I suspect these sales will again start at 5.00 am in the morning which I would imagine that staff would need to be in some time before that.

    I just cannot for the life of me understand why NEXT has to start their sales at such an ungodly hour.

    We now have shops open 7 days a week - sometimes for 10-12 hours a day - which I believe provides ample opportunity for everyone to visit these sales (something akin to a sharks feeding frenzy and I would personally rather insert an agitated wasp up my backside that enter those stores during those sale events).

    I feel sorry for those staff who have to start at such a time - yes I know that there will be those who will welcome the extra pay - but there will likely be more who don't have a choice.

    I was a Christmas temp for Next a few years back. It was fine...Boxing Day wasnt the nightmare I was expecting. You get into a routine with what you are doing, probably packing the shopping as a colleague rings stuff through (I was never trained up on the till as I was only there for a month). Or bringing more stock through.

    I cant honestly remember what time I start on Boxing Day. I think the shop opened at 7am, so the staff were in for 6.30? I could not believe the queue when I turned up and was lucky to get a parking space!

    There appear to be two strands to this. The first is whether the employer permits staff to work in second jobs - it is assumed that it is ok, but some employers have what are called "whole time contracts" and whilst under such contracts you cannot work for someone else. So it certainly isn't an automatic right. But nor is it necessarily wrong. But the pay or not has nothing to do with this - it is what the employer permits under contract.

    Then there is the law. And this is much less clear, but if you are on maternity leave, working for another employer during that time may result in undermining your employment rights as someone on maternity leave. To be honest I cannot recall any cases which involve this, so it's difficult to say for certain - the test perhaps comes if the employer decided to do something about it, which they may or may not. To be honest, I think I would err on the side of caution and suggest that it would be unwise to return to work anywhere other than your employer. I have to agree with Googlewhacker that whatever the law may say, as an employer I might be a tad !!!!ed off if you claim unpaid maternity leave and don't want to come back to work - either involving me in having temp staff covering for you or other staff doing your work - but then go to work somewhere else. Whatever the legal niceities, it isn't good politics.

    I would suggest that if money is an issue, then you should consider making a request for KIT days, or even returning early. It would be a safer bet all round.

    Could I just add to this thread, as I feel I am being painted in a bad light here. I have not intetionally tried to do anything wrong.

    I did not realise that I would be doing anything wrong with working for the 3 days. I have not been trying to be sly on my employer. I have had two jobs before and I have didn't have to inform each employer about the other job, I did not realisse I had to inform my employer. I new that I would not be able to do the work if I was still getting my maternity allowance, but that ends on the 10th and the next job starts on the 15th. I knew nothing about KIT days which have been mentioned in previous posts.

    The reason that I am having a couple of months off unpaid is because of childcare issues over the summer holidays. My job is daytime work in the week, so we would have been paying out a lot in childcare fees over the summer holidays. That is why I felt this would be a good way to give us a few extra pennies, it is weekend work, when I have somebody to look after the children and it was only for 3 days. I could of done this work had a been at my other job too. As on the friday it is in the evening and the rest is weekend work and with my current job I do not work evenings or weekends.

    Also to add, we are allowed to have more than one job in our company.

    My daughter worked at Next for a few years. Sales time was hell. She was expected to start VERY early (4am anyone??) and finish late. Customers were rude, pushed, shoved, threw clothes on the floor, fought and in some instances were carted off by the plod.

    Incidentally - OP? I think you are being over sensitive. I've not seen any rude posts and you've not been painted in any light - bad or otherwise.
