Dolphin Bathrooms in Administration

Hi there.
My wife & I ordered a bathroom from Dolphin a couple of weeks before they went into administation.
My wife payed the deposit by credit card (Marks & Spencer), & I put the balance on hitachi credit. (6 months intrest fee & pay balance off).

Now, our problem is that M&S just aren't interested in helping us. We have asked to make a claim on section 75 but the won't send out a form. They say they are waiting to see what happens to Dolphin. I don't really see how that is relevant.

Secondly my phone calls to Hitachi are met with 'you know as much as we do'.
Am I still liable for the credit? How do I find out?

Anybody out there able to help?

    So have Dolphin actually told you they will not be doing the work?

    When the time comes that it is clear that Dolphin are actually not going to carry out their obligations, I am sure you will have no trouble with a section 75 claim against either (or both) M&S creditcard and Hitachi Credit.
    Both of these are jointly responsible with Dolphin for performing the work.

    Administration doesn't mean the company has gone bust or stopped trading, in fact it's often used to protect a company from bankrupcy or winding up petitions to allow it to restructure.

    A company in administration is still trading, that's why you cannot get a section 75 claim started.

    In many cases the administrators fail to find a solution to the companies problems, at which time you then do issue a section 75.

    In the meantime you are actually dealing with the administrator as a customer of the company.

    The salesman phoned to say the company were in admin, & we wouldn't see our bathroom.
    I've tried phoning Dolphin, but unsurprisingly there is no answer.

    Thanks, the problem is that I'm dealing with no-one as I cannot get through to Dolphin or administrators to discuss it.
    M&S don't want to know & Hitachi seem clueless.

    you need to wait and see what happens next.
    dont hold yer breath. administrators are not known for speed.
    (rarely anyways).
    Get some gorm.
