Carphone warehouse problem

I bought a phone, SE K510i, £79, on 30/06/06. It had a fault and was sent off on 18/11/06 for repair. It went back to the manufacturers, who said they can not fix it, and I caused the fault, (the joy stick stopped working). Now the shop phoned me and told me they can not replace or refund as the fault was not covered by the manufacturers warranty, and beyond economical repair. Carphone warehouse state they only replace or refund if the fault is within 28 days.
My phone is under 5 months old
"Where goods bought after 31 March 2003 prove defective within six months of purchase, there's a presumption that they were defective when they were bought, in which case the seller is in breach of contract (Section 14 Sale of Goods Act)." How will this help if Sony say I caused the fault?

Just got a letter from CPW stating the fault could be due to water getting into the phone, or because its been dropped or knocked and regrettably the fault is not covered by your phone warranty. Oh and they offered 10% off a phone with them.
Well my phone has never been wet and when I took it in to be repaired the salesman remarked how new it looked!

Any help or advice would be appreciated

    this is a common problem with sony ericsson phones, i have had it with my k700i and my mate with his t630

    that is rubbish! the main cause of this is dust/dirt in the joystick mechanism, i usually get a hoover and position it over the joystick and it makes it more responsive
