    We know how difficult it is to claim these benefits. So its hard to believe how someone with 'Mental Health Issues' could do it whilst hiding it all from his partner. Then blow it all on the lottery without stashing some away.

    Sorry to be so blunt, but its pretty obvious you can't believe a word he says and there is a lot we have not been told. Perfectly understandable if you don't want to tell all on a open forum. But we can't advise you when you are keeping so much back. So you really do need to see a solicitor (much as I hate to send more money their way)

    "Mental health problems" can encompass a lot of conditions and please don't assume they are stupid or incapable. My partner is schizophrenic, entitled to benefits (which we don't claim because he chooses to work when he can instead) and he is very, VERY intelligent. Bipolar condition is also something that affects people who are incredibly intellingent. e.g. Stephen Fry. He is well known for having manic spending phases on his gadgets!! Speaking from experience I have no trouble at all believing that someone with a mental health condition could (a) claim benefits (b) keep it secret and (c) spend all that money on something completely ridiculous. It's practically textbook stuff to be honest.

    Is the benefit ESA/incapacity, or is it DLA? as both have a different impact on things, as if it was ESA, then because your mother was working, it is classed as benefit fraud, if it was DLA, then maybe he filled the latest forms out wrong, and they feel there is no need for him to be on the benefits.

    Also, on the subject of him threatening to kill himself if your mother leaves, I would contact your local crisis team, who can usualy be reached on the GP out of hours number, or through the GP, as they are trained mental health staff, who can section him if needs be.
