Its irrelevant like already mentioned you need a witness for him hitting you. As you weren't there when the damage was done it could have been done the day before etc, the photos like I said earlier could have been taken minutes after the hit or even days.Everyones opinion is the most important.....no wonder nothing is ever agreed on.0 -
I thought it that nearly exclusively that if the back of your car is hit buy the front of someone else's that liability stands with the person whos damage is in the front. At least thats what i was told by my insurance company, maybe they deal with claims differently then court. I hate these type of people that hit your car and just outright deny it, wish you all the luck and hope you take him to the cleaners.
Edit: maybe get a recording or something of him denying that he hit your car, then put him on the spot and ask him where the damage came from.0 -

that's when you're driving and somebody drives into the back of you, otherwise i could reverse into the front of somebody's car while they're on holiday and claim it was their fault.0 -
Well i have written to his insurer today signalling my intention to pursue them via small claims. It isnt a costly way of doing it and then i have done my best. Noticed he has washed and polished car today0

Mistake! His insurers will do nothing untill he reports it to them which is why I said you need to write to the TP himself. It would be for him to decide whether to pass it to his insurers to deal with the claim or not. You just wasted a stamp.PLEASE NOTEMy advice should be used as guidance only. You should always obtain face to face professional advice before taking any action.0 -
he will just bin the letter if I send it to him.0
