Jewellery Problem Please advise

Hi all,

I have done a search within this forum and cant seem to find anything that may help me. I hope I'm writing this in the correct place.

My situation is as so:
In Feb of this year, my fianc!e and I were shopping in Cabot circus, Bristol. ( I live in St Albans, She lives in Swindon) We popped into a small Jewellery shop (not sure if Im allowed to write the name, Also as far as I know they only have two branches, around 100 yards from each other) I brought her a engagement ring with a wedding band that she chose for around £675. We went home very happy, however two days later, my fianc!e noticed that the ring was missing a diamond, the ring is however a complicated design (has nine small diamonds cut on the top of it) I contacted the jewellery shop and they requested that we send the ring back by recorded delivery and they will sort the problem out. We were happy to do that and returned the ring to the cost of ourselves. A few weeks later, we received the ring back. Three days after receiving the ring, again a diamond had fallen out, however this time by some miracle we found it, again we contacted them and again we were advised to send the ring back, which again much annoyed and fed up we did so. We received a call a few days later, advising us that they could again put the diamond back but they couldn't guarantee that it wont fall out again.

Much perturbed I requested that we should be allowed to have our money back and call it quits, however I was advised that there was a no refund policy in place and they would not be refunding me. Unaware at the time what my rights were, we were offered another ring, slightly similar to that design, they wouldn't also tell me what clarity of diamond, what gold it was as well, after much persuading they offered to give me all the information I requested and as my fianc!e liked this other ring, we decided as we wouldn't get our money back to accepted the ring that had been offered to us. I sincerley wish that was the end of it...

Around two weeks after again visiting Cabot choosing the ring, taking it back. My fiancee this time now noticed a slight dent in the ring, she assures me that she didnt knock it against anything, and as hard as it is to believe I do believe her lol. I again contact the shop, asked to speak to their manager. Requesting to meet him, which he refused. He stated that he hadn't sold the ring to me dent, wouldn't again be giving me a refund, was extremely rude, arrogant. As you can imagine, with everything that has happened with our ring (s) I was rather annoyed as well.

After a lot of arguing, he suggested that he would try and replace the ring with the original ring that we brought, he stated he would try and get me exactly the same one, I said as that was the ring that my fianc!e had got engaged with, I know she would be happy with that, so I accepted that offer. However after four weeks of not being able to get me that ring, they offered another ring last week. Sick and tired of all the huss and fuss of the ring, we accepted collected the ring on Monday again travelling down to Cabot. The very next day, whilst sitting in the garden, admiring the new ring my fiancee noticed that this diamond was loose as well.

I am ends to what my rights are, if I can in anyway get my money back. Do I just call it quits lose that money and purchase another ring. I have heard about small claims court, getting the ring assessed etc, however have no idea what to do or how to do it. ANY advice would be very very very much appreciated.

Thank you for reading
Kind regards

It's an expensive ring, so diamonds should definitely NOT be falling out.

Time to put your complaint into writing.

Send a letter to the shop, entitled "letter before action", state the list of problems, dates, phone calls etc... and state that you've had enough, just want a good quality engagement ring, and would like a full refund. Give them 14 days to contact you to arrange return of the ring and a full refund, otherwise you have no option but to take them to court to get a refund.

You've given them more than enough chances...
Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')

No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

Thank you pink shoes, just a small question as naive as it sounds how do I take them to court? Do I make a claim
In the small claims court? Sorry I know I sound really naive but I haven't a clue. I've been searching online and can't seem
To find anything substantial. Many thanks

I've never used it myself, but I've been told that this
    https://www.moneyclaim.gov.uk/web/mcol/welcome
is the cheapest and easiest way to try to claim for a fixed sum of money.
