  • thesaint, thats exactly what I want to prove but where chant1 says "In Law..." I need to find out what law this is so I can quote it exactly to the LA. I assume it's in the Housing Act but I can only find mention of the the above notice being required on expiry, not after a break clause.

    You should find the info on there. I honestly don't know the law.

    Why do you need to know this information now? If the landlord were to only give you 6 weeks notice, you tell him that you need 8 weeks notice.
    If he were to disagree would have to wait until you overstay and then take you to court.

    Try the Shelter website too. I think it's 2 months notice from the rental payment date, but if this can be varied unilaterally not sure. Don't sign until you have clarified it though as you could be signing away a right.

    AST statutory notice is 2 months from a rent payment date to expire the day before your normal rent payment date ie you pay your rent on 28th, your lease runs until 27th (2 months time). Be careful on informal, private arrangements that you negotiate with LL or LA beyond that (say you need to stay another 2 weeks) and get those in writing as once the AST lease is up, he can evict you at any point and if he goes to court, you pay his legal costs. Plus being taken to court doesn't look too good for your next rental.
    Insist that your AST agreement complies with the law ie you get 2 months notice after the 6 months is up.
