Tenancy Deposit not being returned by Foxtons

Ok, well firstly i shall say i told my son to go nowhere near Foxtons, but he did anyway.

My son exited his flat, rented through Foxtons, on the 9th June. In his tenancy agreement it states his deposit money should be returned within 10 days of him exiting the flat save any disputes, which there were none.

As of today, 29th June, he has not had his deposit back. His girlfriend received a phone call today from Foxtons (witheld number of course) claiming the landlady through the cleaning that was carried out wasn't good enough and she was deducting the price of another cleaning job from the deposit. His girlfriend told them they had had a professional clean done, were very happy with it and Foxtons had confirmed they were in receipt of the cleaning invoice. Not to mention any disputes had to be put to them in writing within 10 days, which hadn't been done.

My son phones Foxtons who deny this phone call ever took place and informed him his deposit money had not been returned due to an error on their systems, not a dispute from the landlady. They also told him they didn't know when he would get his money back.

So he phones mydeposits.co.uk , who hold the deposit to open up a dispute against Foxtons with them. They told him that they were not a very quick acting company, it will take 3 months and he shouldn't bother and just try and get Foxtons to return the money.

What is the point of this scheme if they allow crooks like Foxtons to carry on like this?

Is there anything else or anyone else he can contacted that will take action immediately. For him this is a lot of money and he needs it.

Oh and please heed my warning, NEVER, EVER, UNDER ANY CIRCUMSTANCE, USE FOXTONS

    You son should get onto the MyDeposits website and claim the whole of his deposit back. If Foxtons or the landlord they represent want to claim any monies from it your son should dispute it. The onus of proof will then be for them to prove their position to the arbitrators.

    Tell your son to sit in the local foxtons branch until he receives his money back. I reckon a few hours of complaining loudly whenever new customers come in should do it. Oh, and tell him to make sure he gets his free cup of coffee from them

    Everyone knows their a bunch of crooks and liars, but people still use them. Beggars belief. I suppose you have to make the mistake to truly learn from it.

    Use mydeposits. They shouldn't have put him off like that. That's what they are there for.
