    Post dated cheques have no legal standing. :-(
    As theartfullodger states "Both of you may not be aware post-dated cheques if paid in will probably go straight through... and get paid & take the funds from your account."

    There might not be anything shady going on, my parents let a flat out and although my dad is the one who deals with the tenants the flat is in my mum's name and the rent is her 'income' as she doesn't work anymore and obviously it makes sense to have the money going to the person who pays less tax.

    OP, I think banks can make a cheque up for you without you having a cheque book- I have done that to move money between accounts, but I'm not sure they would put different dates on them.

    Cant see it being a tax dodge, it would be much easier to call round and collect cash if the LL had that in mind. Cheques are being phased out by 2018 anyway. I do business (not in the lettings industry) and come across a few customers who cannot pay by cheque as they do not have a book. In such circumstances I take a card payment.

    OP what does the receipt for your deposit say? It is out of order for the LL to introduce this condition after you have already paid the deposit and you may have redress.

    Post-dating cheques will be a breach of the terms and conditions of all bank accounts.

    Tell him you've checked with your bank and they've made that quite clear.

    Just make sure you do it after you have left and got the reference and deposit back. If the LL is paying tax then there is no problem, if he is not then I (and you) are paying the tax for him.

    I think you will find its not illegal to issues post dated cheques, it only causes a problem if a bank accepts them prior to the date on the cheque.

    The bank will accept them prior to the date on the cheque though...

    Indeed they do - intentionally to defeat the purpose of a post-dated cheque, so making it pointless for an account holder to write one.

  • So just to clarify as I was not aware of this prior to paying the deposit I am within my rights to pay another way. The contract is a standard one which states payment by SO etc, he has just written in about the cheques.
