PayPal claim - have I made a mistake?

I won an auction for item number 170052643925 and paid the same day 1st December via paypal. Auction states item will be sent on receipt of payment.
As I hadn't heard anything from the seller by the 8th Dec and hadn't received anything I thought I would email them to ask if they could let me know when item they were posting item so I could look out for it. I heard nothing in reply.
On the 13th Dec I opened a dispute via paypal and as I hadn't heard anything 24 hrs later (fuelled by being able to see the seller is online almost all the time as we share the same internet provider and hadn't responded to anything in nearly 2 weeks) I escalated the dispute to a claim.
Just noticed on the auction details that Paypal has not provided Buyer Protection on this item - I hope this doesn't mean I have to pay an admin charge - can anyone clarify please? I want the seller to get a strike on their account for not sending item, no communication etc but I don't want to be out of pocket even more than I am now.
The claim will close on the 24th December if the seller doesn't respond. Can I then leave negative feedback? Do I run the risk of getting bad feedback in return?

If you didn't have buyer protection, there's a possibility they won't be able to retrieve the money. If this happens, you can take it up with your credit card provider.
If the seller hasn't responded to the dispute by the time the dispute is escalated (do this as soon as you can) he won't be able to leave you feedback.
Either way, it's best to leave a negative where it's deserved!My TV is broken!
Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j0 -
Thank you - I will be leaving negative feedback. If I don't receive my money back - well thats a loss I will take on the chin, however, I didn't want to be paying out on admin charge on top.

I'm starting to wonder if the 'fail to respond to dispute = not allowed to leave feedback' thing applies to sellers as well as buyers. It may notMy TV is broken!
