Mobile Phone not as advertised!

Hi,
I have just received the mobile phone (Sony Ericcson W850i) which we successfully bid on. However, it is NOT as advertised. Despite emailing the seller he/she is choosing to ignore us. It is for a child's Christmas present, so any advice on what to do next would be appreciated. Thanks in advance -Sally

    Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j

    If you paid by paypal and the phone is significantly different to that advertised you may want to consider a claim for 'item not as described'.

    Whether you would win such a claim is not 100% certain though, if the phone was sold as used then it can be difficult to say how used something is, if the phone was sold as new, but is actually used the claim should be easier.

    doesn't matter. ebay can and will chase them for the debt and suspend their ebay/paypal account.
    It's BOUGHT (to Buy), not BROUGHT (to bring) AND you cannot be frauded, only DEfrauded.

    Please do not buy animals from a pet store. Visit your local sanctuary or centre and give a good home to an unloved or abandoned animal.

    doesn't matter. ebay can and will chase them for the debt and suspend their ebay/paypal account.

    Is it possible this only applies in case of CC chargeback... or where buyer protection applies?

    Otherwise I can't explain why people don't always get a full refund through paypal.

    the OP has mentioned in another thread it was advertised as unlocked and it isnt.

    Go to your local little mobile phone shop, 5 minutes and around a tenner usually :) I personally wouldnt go to the network the phone is locked to, they tend to charge more.

    i think these can only be unlocked by the network themselves at the moment

    Gaming guy, no, they can be unlocked by any phone dealer who has the software to do so. They would also need the standard sony ericsson unlocking cable which most already have.

    There are a couple of online retailers offering the software, and doing the "send away" unlocking so the OP should find a shop near to her that will do this for her.

    gaming_guy is correct. a se w850i is a db2020 phone, and hence impossible to unlock by software/box at present unless you are a se service centre with emma iii crypto card access.

    but as its on vodafone its possible to get the unlock code from someone who have access to the vodafone database.
