POLICY ADMIN - Phone Insurance claims

I recently made an insurance claim to Policy Admin when I accidentally left my Iphone 4 abroad at the airport on my way back to the UK. They rejected my claim as they said it was Negligence on my behalf!!

as quoted below is from Policy Admin's policy
"Theft or loss where the mobile device has been left negligently or deliberately in a public place or a place to which others have access"

I think this is a very ambiguous part of their policy to cover people for 'loss' of their device and they could argue almost ANY loss is Negligence and I wonder how many people are rejected by insurers for these types of claims against 'loss'.

I am about to appeal against the decision and the basis of my appeal is that, that part of the policy is ambiguous and also due to the fact I was at an airport where it is well known that airports can be one the most stressful things a person can do I AND it was my first time abroad and I wouldn't have been thinking completely correct and neglect cant be a factor in this?

    Does the policy claim it cover against loss (other than theft)? The wording above would make it seem like it is unlikely to.
  • yeah pretty sure is does cover against loss as well as theft.. 2 separate things.. it covers against the following as stated in their online leaflet.

    "What do you get with premierplan?
    The comfort of knowing your mobile device is covered for:
    • Loss
    • Theft
    • Accidental and malicious damage
    • Electrical and mechanical breakdown
    • Unauthorised charges up to £10,000 per claim, in case someone else uses your lost or stolen device"


    and then goes on further in the t&c with only one line (as quoted earlier) about exclusions of loss and I which is also a direct reference of the reason why my claim was dismissed... "negligence"

    Protect my bubble have a similar clause.

    I suppose you have to know where you lost it to claim.
    Like drop it down a drain, (actually, that's the only one I could think of)

    i knew exactly where i last had it.. and i imagine almost any reason for the loss you can give them, they could just turn around and say it was neglect on your behalf.. dropping it down a drain could be neglect because that person shouldnt of had near a drain and should have it securely on them! makes no sense to me!!
