Hi All,
A new member here so I apologise in advance if I've bunged this in the wrong place.
I need a bit of advice as my credit report is being hammered... I was applying for a mortgage a while ago and when going through the process something popped up on my credit report. I knew two major things would come up but I could explain them both away. Firstly an overdraft with Clydesdale Private for £92k which was paid off in full in 2009. Second was a CCJ for £26k which was paid off in Feb 2011 and is marked as satisfied on my credit report. I provided them with all the documentation to this effect and they were fine. To my surprise they then said "What about your Opus Card that has been in default every month for 18 months"?
I immediately got a report from Experian and Equifax, interestingly "Opus" is only showing on one of the reports. I contacted Opus through their complaints section explaining that I have never had an Opus card, have only ever had a Capital one card and one issued from my bank both of which I still have. They wrote back asking me to prove who I was and to send a bank statement for February 2008 to prove I didn't live at the address the card was registered at.
I have since found out that the card is in my first and surname but the middle name is James on the card, my middle name is Louis. This is obviously a case of mistaken identity. I have today sent a CCA request based on the fact I received another letter from them this morning demanding proof of where I lived in Feb 2008 and stating they have applied a company called Cabot to recover the debt in full.
The debt is for £1001.00. Is there anything that can be done about this immediately as it is holding up the purchase of my house and is costing a lot of money whilst we're all waiting for it to be sorted out. Also when it is resolved what will happen to all the defaults on my credit report will it simply be removed?
Any advice will be greatly appreciated.

Did you live somewhere else in 2008?
Have you sent them the proof when they asked for it?
When was that?Is there anything that can be done about this immediately
Did you send them proof at their first request? if so when?
If you lived at the same address then why haven't you had the post. Can anyone tamper with your mail i.e. is it in box accesible to other people? Also when it is resolved what will happen to all the defaults on my credit report will it simply be removed?
I don't think there is anything you can do to make it happen immediately though.
So have you replied to their first request?
If not why not?
You can certainly threaten them with costs if they have made a mistake which result in a financial loss to you, but be careful how you handle it.
Sometimes being charming can get people to help you more than going in "all guns blazing".0 -
Hi, thank you for your prompt reply. In 2008 I had a rented property in Fulham and was living between London and New York. This card is registered at an address on South East London which isn't somewhere I have ever lived. I have sent them the front page of my rental agreement for the property I was living at in 2008 whilst I await receipt of a statement requested from my bank at the time.0

Your going to have to provide irufutible (sp) proof that you didn't take the loan out. Is it possible that when that card went into default they mistakenly tracked you down at your address. Also if the address is the same how come you have not had any mail regarding the default.0

You shoule be ok as long as you provide what they ask for. Sounds like mistaken identity. i.e Tracking down the wrong person or simply putting the default on your file by mistake.0

Presumably they have tracked me down now thinking I am that man. The mistake I seem to of made was contacting them and giving them my current address as they are sending Cabot letters to my home now, something I hadn't had before at all.0
