HELP! We've paid a deposit and want it back!

QUERY2011
We have paid a large deposit on a holiday home in good faith to secure the purchase and to ensure no further viewings. We later received all the contract details (2 working days later) to discover a clause that was never made clear to us and that has now made us question the purchase. We have NOT signed any contract. Can we demand our deposit back? Thanks...worried....:(

you really need to be providing detail to the issue at hand - no one can provide you with advise based on the vague post above im afraid...0

I am not a legal expert but I would say you have grounds to claim the deposit back if there is a case that you have been mis sold the product by them deliberately witholding information from you which would have an impact on your decision whether to buy or not.
Personally I would get proper legal advice as I'm sure no doubt it could get messy. But I think you have a case if they have not given you some important information regarding the purchase.0 -
As the other posters have said hard to give approp advice without all the details. However as a general rule of thumb misrepresentation may apply in this case therefore allowing you to cancel the contract. You might wish to speak with Consumer Direct (google it) for advice. Good luck.0

A lot would depend if it was abroad as well.0

Was the clause to do with permitted times to stay / live there ?0

OP you have no chance of getting an agreed deposit back, Verbal or signed contract makes no difference.0

Shouldn't the terms of sale be agreed BEFORE placing a deposit down to secure the sale?0

My thoughts exactly.
Did you read the terms of sale OP?
Has the vendor changed the terms of sale? (If so then you might very well have a case, if not then I would be surprised if you have a case.)
Did you get your solicitor to check all the terms?0
