    No. Tribunals are not allowed to infer terms of employment in this way. Especially not now (new case law in place). The OP states that the contract is specific - 40 hours basic and 8 hours overtime for which an enhanced overtime rate is paid. There is no room for interpretation.
  • Well a decision has been made and we are getting paid our overtime as it is a implied contract RESULT :)
