Enviroment Search - nr to Landfill

Hi,

Im hoping someone can advise.

Ive had my enviromental search come back for my property purchase & it states that the contaminated land assesment has come back saying further assessment is needed.

The property im buying is next to an old railway line & the map shows a small section has been used for landfill. The details on the search say the licence was issued in 1993 & it was for a farm???

The solicitors have said they have written to the local council for further info.

Is this something I should be worried about?

    Planning Policy Statement 23 on contaminated land was published in 2004 so the planning permission for your house should really have been considered in light of this document, especially as it is near a railway and landfill. Unless they got permission and took a couple of years to implement the permission.

    If permission was granted after 2004 then investigations should have been carried out as part of the application to make sure that the site was surveyed and any contamination found removed safely.

    If you want to make your own enquiries independent of your solicitors I would see if you can get access to the planning file by requesting to see it at your local planning office. You could also try to speak to Environmental Health's Contaminated Land Officer who should hold records on whether any remedial work was carried out on the land.
  • The property is not actually on the land just next to it. There are other houses nearby that would have been there when it was used.
  • Just had a closer look at the report & the licence was issued for inert waste.
  • Can anyone give me anymore advice on this?
