unpaid item dispute

okay. so I bought tickets for Bon Jovi on the 21st
i was for my ex so i was liasing over the phone with her and her sister
bought some that offered collection in Edinburgh as the concert was the next day
after buying I later got an email saying they were sold :mad: so i jumped on eBay and eventually found some to collect the next day
today I log into eBay and note I have an unpaid item dispute open against me with the seller wanting to cancel
looking,the case was opened 10 minutes after the sale
now this has peeved me somewhat. why should I accept this and allow the seller their fees back?
all they had to do was cancel the listing or at least add a note on the listing to show they were sold
I hadnt even looked at the transaction after being told they were sold as I then had to rush and get on with finding more.

obviously the seller doesn't have the item to sell but getting an email with warnings of unpaid item strikes is a sure fire way to flag up negs and even possible auction wreckers

so sellers,think through your actions
